{"id":96766,"date":"2025-07-23T15:23:05","date_gmt":"2025-07-23T15:23:05","guid":{"rendered":"https:\/\/pakistaninewspaperlist.com\/news\/in-landmark-opinion-the-world-court-says-climate-change-is-an-existential-threat\/"},"modified":"2025-07-23T15:23:05","modified_gmt":"2025-07-23T15:23:05","slug":"in-landmark-opinion-the-world-court-says-climate-change-is-an-existential-threat","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/in-landmark-opinion-the-world-court-says-climate-change-is-an-existential-threat\/","title":{"rendered":"In landmark opinion, the World Court says climate change is an \u2018existential threat\u2019"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>The United Nations\u2019 highest court on Wednesday underlined \u201cthe urgent and existential threat posed by climate change\u201d as it started to read out an opinion on the legal obligations of states to take action.<\/p>\n<p>The non-binding opinion by the International Court of Justice (ICJ), also known as the World Court, is likely to determine the course of future climate action across the world.<\/p>\n<p>\u201cGreenhouse gas emissions are unequivocally caused by human activities which are not territorially limited,\u201d Judge Yuji Iwasawa said. The reading of the opinion was ongoing and the court had not yet announced its conclusions.<\/p>\n<p>Ahead of the ruling, supporters of climate action gathered outside the ICJ, chanting: \u201cWhat do we want? Climate justice! When do we want it? Now!\u201d<\/p>\n<p>Although it is non-binding, the deliberation of the 15 judges of the ICJ in The Hague will nevertheless carry legal and political weight and future climate cases would be unable to ignore it, legal experts say.<\/p>\n<p>\u201cIt is so important, it could be one of the most consequential legal rulings of our times because of the scope of the issues that it touches, which run to the very heart of climate justice,\u201d said Joie Chowdhury, senior attorney at the Centre for International Environmental Law.<\/p>\n<p>The two questions the UN General Assembly asked the judges to consider were: what are countries\u2019 obligations under international law to protect the climate from greenhouse gas emissions; and what are the legal consequences for countries that harm the climate system?<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:250px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1890909\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>In two weeks of hearings last December at the ICJ, wealthy countries of the Global North told the judges that existing climate treaties, including the <a href=\"https:\/\/www.dawn.com\/news\/1226151\/paris-agreement-turning-point-for-world-climate-says-obama\">2015 Paris Agreement<\/a>, which are largely non-binding, should be the basis for deciding their responsibilities.<\/p>\n<p>Developing nations and small island states argued for stronger measures, in some cases legally binding, to curb emissions and for the biggest emitters of climate-warming greenhouse gases to provide financial aid.<\/p>\n<h2><a id=\"paris-agreement\" href=\"#paris-agreement\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>Paris Agreement<\/h2>\n<p>In 2015, at the conclusion of UN talks in Paris, more than 190 countries committed to pursue efforts to limit <a href=\"https:\/\/www.dawn.com\/news\/1913992\">global warming<\/a> to 1.5 degrees Celsius.<\/p>\n<p>The agreement has failed to curb the growth of global greenhouse gas emissions.<\/p>\n<p>Late last year, in the most recent <em>Emissions Gap Report<\/em>, which takes stock of countries\u2019 promises to tackle climate change compared with what is needed, the UN said that current climate policies will result in global warming of more than 3\u00b0C above pre-industrial levels by 2100.<\/p>\n<p>As campaigners seek to hold companies and governments to account, climate\u2011related litigation has intensified, with nearly 3,000 cases filed across almost 60 countries, according to June figures from London\u2019s Grantham Research Institute on Climate Change and the Environment.<\/p>\n<p>So far, the results have been mixed.<\/p>\n<p>A German court in May threw out a case between a Peruvian farmer and German energy giant RWE, but his lawyers and environmentalists said the case, which dragged on for a decade, was still a victory for climate cases that could spur similar lawsuits.<\/p>\n<p>Earlier this month, the Inter-American Court of Human Rights, which holds jurisdiction over 20 Latin American and Caribbean countries, said in another advisory opinion that its members must cooperate to tackle climate change.<\/p>\n<p>Campaigners say Wednesday\u2019s court opinion should be a turning point, even if the ruling itself is advisory.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:250px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1891067\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>The ruling could also make it easier for states to hold other states to account over climate issues like pollution or emissions.<\/p>\n<p>\u201cThe court can affirm that climate inaction, especially by major emitters, is not merely a policy failure but a breach of international law,\u201d said Fijian Vishal Prasad, one of the law students who lobbied the government of Vanuatu in the South Pacific Ocean to bring the case to the ICJ.<\/p>\n<p>Although it is theoretically possible to ignore an ICJ ruling, lawyers say countries are typically reluctant to do so.<\/p>\n<p>\u201cThis opinion is applying binding international law, which countries have already committed to,\u201d Chowdhury said.<\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>The United Nations\u2019 highest court on Wednesday underlined \u201cthe urgent and existential threat posed by climate change\u201d as it started to read out an opinion on the legal obligations of states to take action.
