The International Court of Jurists <a href=\"https:\/\/www.dawn.com\/news\/1866652\">derided<\/a> the \u201cblow to judicial independence\u201d when the 26th Amendment was signed into law.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:250px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1874955\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>Some of the major changes made to the Constitution included changing the process of the chief justice of Pakistan\u2019s appointment, taking away the high courts\u2019 suo motu powers, formation of constitutional benches, and performance evaluations of high court judges.<\/p>\n<p>The Judicial Commission of Pakistan (JCP) had last week <a href=\"https:\/\/www.dawn.com\/news\/1877116\">approved<\/a> the formation of a committee led by Justice Jamal Khan Mandokhail to constitute rules and criteria for appointing judges by December 15.<\/p>\n<p>In a letter written to Justice Mandokhail a day ago regarding the task ahead, seen by <em>Dawn.com<\/em>, Justice Shah said: \u201cThe judiciary of Pakistan is passing through one of its weakest moments in our history, and the risks of executive overreach are higher than ever.\u201d<\/p>\n<p>He said he had \u201cdeep concern\u201d regarding the formulation of rules for the appointment of judges to constitutional courts in Pakistan, a matter which he called of the \u201cutmost significance to the independence of the judiciary, the rule of law and democracy in our country\u201d since it was mandated upon the JCP by the Constitution.<\/p>\n<p>\u201cIn the absence of such rules, any proceedings undertaken by the commission for the appointment of judges would be unconstitutional,\u201d the senior puisne judge pointed out.<\/p>\n<p>Justice Shah said the judiciary had enjoyed primacy in the appointment process of judges but the vital balance was \u201cfundamentally disturbed\u201d under the 26th amendment, granting a majority to the executive in the JCP.<\/p>\n<p>\u201cThis unprecedented shift in the composition of the JCP poses grave risks, including the potential for political appointments and the packing of courts with judges lacking an ideological commitment to the rule of law,\u201d the judge warned.<\/p>\n<p>He stressed that appointments made without a \u201cwell-defined and transparent framework of rules\u201d would undermine public confidence in the judiciary, compromise its independence, and erode its ability to function as a neutral arbiter of justice.<\/p>\n<p>\u201cThe selection and appointment of judges must be structured and well-reasoned and never be left vulnerable to arbitrary or politically motivated decisions.<\/p>\n<p>\u201cIn these circumstances, it becomes imperative that well-thought-out rules are framed that provide the necessary filters to select the best of the best, thereby safeguarding judicial independence and ensuring merit-based selections.\u201d<\/p>\n<p>He urged the five-member committee tasked with drafting the rules that selecting the best judges that would promote the rule of law required a focus on objective, fair and forward-looking criteria.<\/p>\n<p>Justice Shah proposed several criteria and factors that he said potential nominees should be judged for.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" style=\"height:250px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1878399\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>\u201cBy adopting this comprehensive approach, the JCP can ensure a fair, robust and merit-based selection process that aligns with the principles of judicial independence and rule of law.<\/p>\n<p>\u201cThe absence of robust rules and criteria will allow outside influence to undermine the judiciary by facilitating appointments that serve partisan interests rather than upholding constitutional values,\u201d he pointed out.<\/p>\n<p>The judge stressed that it was critical that \u201cno appointment to the constitutional courts proceeds until these rules are finalised and adopted by the JCP\u201d, saying that the approach was essential not only for ensuring the independence of the judiciary but also for enhancing public trust in the courts as \u201cbastions of justice, the rule of law and democratic accountability\u201d.<\/p>\n<p>\u201cAny hurriedness in the matter by the JCP can seriously undermine and weaken the judiciary for years to come,\u201d Justice Shah warned.<\/p>\n<p>He concluded by expressing trust that Justice Mandokhail would \u201crecognise the urgency and importance of this matter and act decisively to ensure that the process is both fair and resistant to outside influence\u201d.<\/p>\n<p>The JCP will <a href=\"https:\/\/www.dawn.com\/news\/1878468\">meet on Dec 21<\/a> to consider 10 nominations for four vacant positions of the Islamabad High Court judges.<\/p>\n<p>Justice Shah said he looked forward to the draft rules in the Dec 21 meeting. \u201cI understand that unless the rules are finalised by the JCP,
