{"id":75927,"date":"2024-03-27T09:22:27","date_gmt":"2024-03-27T09:22:27","guid":{"rendered":"https:\/\/pakistaninewspaperlist.com\/news\/calls-for-probe-into-letter-by-6-ihc-judges-on-brazen-meddling-in-judicial-affairs\/"},"modified":"2024-03-27T09:22:27","modified_gmt":"2024-03-27T09:22:27","slug":"calls-for-probe-into-letter-by-6-ihc-judges-on-brazen-meddling-in-judicial-affairs","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/calls-for-probe-into-letter-by-6-ihc-judges-on-brazen-meddling-in-judicial-affairs\/","title":{"rendered":"Calls for probe into letter by 6 IHC judges on \u2018brazen meddling\u2019 in judicial affairs"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>Calls emerged from various quarters on Wednesday for a probe into <a href=\"https:\/\/www.dawn.com\/news\/1824028\/ihc-judges-detail-brazen-meddling-in-letter-to-supreme-judicial-council\">allegations<\/a> made by six Islamabad High Court (IHC) judges against interference in judicial affairs by the country\u2019s intelligence apparatus.<\/p>\n<p>On Tuesday, six IHC judges \u2014 out of a total strength of eight \u2014 wrote a startling letter to the Supreme Judicial Council (SJC) members, regarding attempts to pressure judges through abduction and torture of their relatives as well as secret surveillance inside their homes.<\/p>\n<p>The letter addressed to SJC members \u2014 Chief Justice of Pakistan (CJP) Qazi Faez Isa, Supreme Court Justices Mansoor Ali Shah and Munib Akhtar and IHC CJ Aamer Farooq and Peshawar High Court CJ Mohammad Ibrahim Khan \u2014 also questioned if there existed a state policy to \u201cintimidate\u201d and coerce judges.<\/p>\n<p>The six judges also supported the demand of the former IHC judge, <a href=\"https:\/\/www.dawn.com\/news\/1823124\">Shaukat Aziz Siddiqui<\/a>, for a probe into the allegations of interference by Inter-Services Intelligence (ISI) operatives.<\/p>\n<p>The IHC Bar Association (IHCBA) demanded the CJP hold a \u201ctransparent inquiry\u201d into the matter and that legal action be taken against those involved.<\/p>\n<p>In a press release, the association said its cabinet held an emergency meeting. The lawyers\u2019 body \u201cstrongly condemned the interference of one institution into the matters of another institution\u201d.<\/p>\n<p>It further demanded that the \u201cjudiciary ensure independent decisions according to the law and the Constitution without fear or danger\u201d. It also commended the six IHC judges for their \u201ccourage and bravery\u201d.<\/p>\n<p>The association said that if needed, it would prove to be a vanguard for the judiciary\u2019s independence and \u201cwould take every step needed for the supremacy of the Constitution and the law\u201d.<\/p>\n<p>\u201cThe IHCBA would not even hesitate from holding a lawyers representative convention, countrywide lawyers convention, strike, hunger strike and running a movement if needed for the judiciary\u2019s independence,\u201d it asserted.<\/p>\n<p>The Lahore High Court Bar Association (LHCBA) demanded \u201cimmediate action against those intelligence agencies and their personnel involved in such nefarious activities and [that] they be punished for undermining and subverting of the Constitution and the law\u201d.<\/p>\n<p>It further demanded \u201cimmediate action by the SJC against those judges who cooperate with such intelligence agencies, thus playing havoc with the administration of justice\u201d.<\/p>\n<p>Condemning the alleged interference in the \u201cstrongest terms\u201d, the LHCBA said it was a \u201cserious threat to the rule of law and independence of judiciary\u201d.<\/p>\n<p>The body said that the current CJP and his predecessor \u2014 Justice Isa and Justice Umar Ata Bandial \u2014 \u201cfailed to act timely to avert this grave situation\u201d.<\/p>\n<p>It further said that the IHC chief justice had \u201cfailed to protect his fellow judges and the judges subordinate to IHC\u201d, terming his conduct \u201cnot appreciable\u201d.<\/p>\n<p>\u201cWe expect from CJP to act towards the protection of judges of the superior courts as well as the subordinate courts [\u2026] and to create conditions and [an] environment in which judges can dispense justice without any fear or favour,\u201d the LHCBA said.<\/p>\n<p>In an open letter, Supreme Court Bar Association (SCBA) Additional Secretary Sardar Shahbaz Ali Khosa urged CJP Isa to take suo motu notice of the matter under Article 184(3) of the Constitution and conduct a \u201cthorough and transparent (live) hearing\u201d of the case.<\/p>\n<p>He also called for an \u201cimmediate and rigorous scrutiny\u201d into the allegations. \u201cThe judiciary must be a safe haven for the pursuit of justice, untouched by the shadow of coercion, fear, or undue influence,\u201d Khosa said.<\/p>\n<p>He also highlighted a \u201crecent crackdown on journalists and media outlets who have reported on these alleged interferences\u201d and urged CJP Isa to summon prominent journalists across Pakistan to detail the \u201cextent of interference and coercion that the free press is being meted to on an everyday basis\u201d.<\/p>\n<p>The SCBA official further called for a meeting of the SJC to be convened on the issue and \u201cnot only ascertain the way forward but also fix responsibilities\u201d.<\/p>\n<p>\u201cThe SCBA of Pakistan, alongside lawyers and bar associations across the nation, will and must stand ready to support our judiciary in upholding the rule of law,\u201d the open letter stated.<\/p>\n<p>\u201cFor if we are not just today or turn a blind eye or a deaf ear, history will surely judge us harshly even if it is after fifty years,\u201d it added.<\/p>\n<p>The Balochistan Bar Council also called on CJP Isa to take a suo motu notice of the allegations. In a press release, the council expressed its concerns over the matter and said the alleged interference in judicial matters was \u201ccondemnable and unacceptable in any circumstances\u201d.<\/p>\n<p>The bar council also demanded that the Pakistan Bar Council convene a conference of lawyer representatives from across the country to decide on a plan of action.<\/p>\n<h2><a id=\"pti-calls-for-impartial-inquiry\" href=\"#pti-calls-for-impartial-inquiry\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>PTI calls for \u2018impartial inquiry\u2019<\/h2>\n<p>Meanwhile, a <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/twitter.com\/ImranKhanPTI\/status\/1772708750844903518\">statement<\/a> posted on the X account of former prime minister Imran Khan \u2014 who is currently incarcerated \u2014 \u201cwelcomed the six brave judges [\u2026] who have highlighted the alarming state of affairs of the higher judiciary\u201d and called for an \u201cimpartial inquiry\u201d into the matter.<\/p>\n<p>\u201cThis letter with its two annexures, brings on the record the brazen and shameful interference of the intelligence agencies in judicial matters, which is a damning indictment against the independence of the judiciary in the country,\u201d the statement said.<\/p>\n<p>\u201cThe fact that the judges have been intimidated and coerced into giving judgments based on political expediency raises a lot of questions on the fairness of the courts and their judgments over the last two years,\u201d it added.<\/p>\n<p>It said the letter also questioned the \u201ccredibility of the state narrative with results to <a href=\"https:\/\/www.dawn.com\/news\/1751782\">May 9<\/a>, an event instigated within the IHC when Chairman PTI Imran Khan was abducted and dragged from the court premises by paramilitary forces, who stormed the building of the IHC\u201d.<\/p>\n<p>Highlighting that a \u201cwave of political victimisation has been unleashed\u201d against the party, the PTI said that \u201ccourts have been unable to assert their authority or dispense justice\u201d.<\/p>\n<p>The statement emphasised that as the IHC and its lower courts were where most of the cases against Imran were sub judice, \u201cthe fact that this court is under influence and pressure raises serious doubts on these cases as well\u201d.<\/p>\n<p>Separately, PTI\u2019s Barrister Gohar Ali Khan called for ensuring the safety of the judges who had written the letter as well as their families. This is extremely important for the independence of the judiciary,\u201d he said.<\/p>\n<p>He further said that the letter detailed alleged interference in \u201cpolitically consequential matters\u201d. He said that after the letter, it was clear that \u201cdue process\u201d was violated in the cases against Imran. \u201cThis is proof that all those decisions are now null and void,\u201d he said, calling for Imran\u2019s immediate release.<\/p>\n<p>He also called on legal bar councils and associations to set aside political differences and make efforts to rid the judiciary of \u201cinterference\u201d. He assured the country\u2019s lawyers that the PTI would stand with them in this endeavour.<\/p>\n<p>\u201cPolitics is silent today. We stand in solidarity with the judiciary,\u201d he said as he urged the SC to constitute a larger bench to hear the matter from tomorrow.<\/p>\n<p>\u201cThis is not a letter, this is a charge sheet. This is a complaint and there should be further proceedings,\u201d he said.<\/p>\n<p>At the same presser, PTI Secretary General Omar Ayub Khan termed the letter a \u201ccharge sheet\u201d and \u201can indictment\u201d.<\/p>\n<p>\u201cThe system has been exposed [\u2026] the rule of law no longer exists,\u201d he said. He further said that it had now become clear that the target of the alleged interference was Imran.<\/p>\n<h2><a id=\"judges-lauded-for-showing-bravery\" href=\"#judges-lauded-for-showing-bravery\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>Judges lauded for showing \u2018bravery\u2019<\/h2>\n<p>PPP\u2019s human rights cell president and former senator Farhatullah Babar said that the letter by the six judges about \u201ctheir coercion, intimidation and invasion of privacy by agencies is beyond wildest imagination\u201d.<\/p>\n<p>\u201cSweeping it under the rug is inviting disaster, hastening implosion. Eternal gratitude to judges for standing up and calling [a] bluff at [a] huge risk,\u201d he said.<\/p>\n<p>\u201cAs an advocate of the high courts of Pakistan, I stand in solidarity with the judges of IHC,\u201d said Barrister Khadija Siddiqi.<\/p>\n<p>Activist Usama Khilji said that \u201cthe bar must stand with the bench with full force to uphold the independence of the judiciary in Pakistan\u201d.<\/p>\n<p>Human rights lawyer Imaan Zainab Mazari-Hazir termed the letter \u201chuge\u201d. \u201cEveryone has known the pressure the courts have been under but the bravery of these 6 judges must be applauded,\u201d she said.<\/p>\n<h2><a id=\"the-letter\" href=\"#the-letter\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>The letter<\/h2>\n<p>Dated March 25, the letter was signed by IHC Justices Mohsin Akhtar Kayani, Tariq Mehmood Jahangiri, Babar Sattar, Sardar Ejaz Ishaq Khan, Arbab Muhammad Tahir and Saman Rafat Imtiaz.<\/p>\n<p>It mentioned seven instances of alleged interference and intimidation \u201cto influence the outcome of cases of interest\u201d by the intelligence officials, pointing out that when two out of three judges in the bench hearing the plea to disqualify PTI leader Imran Khan for concealing his alleged daughter <a href=\"https:\/\/www.dawn.com\/news\/1752237\">opined<\/a> that the case was not maintainable, they were pressured by \u201coperatives of the ISI\u201d through friends and relatives.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1754723\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>The situation got so stressful that one of the judges had to be admitted to hospital due to high blood pressure, the letter said.<\/p>\n<p>According to the six judges, the matter was brought to the notice of the IHC chief justice and the then-CJP. The former informed the judges that he had \u201cspoken to the DG-C of ISI and had been assured that no official from ISI will approach the judges of the IHC\u201d.<\/p>\n<p>The letter complained that \u201cinterference on the part of intelligence operatives\u201d continued even after IHC CJ\u2019s assurance.<\/p>\n<p>It also referred to the abduction of an IHC judge\u2019s brother-in-law by armed men who claimed to be ISI operatives. The victim was \u201cadministered electric shocks\u201d and \u201cforced to record a video\u201d making false allegations, apparently against the judge.<\/p>\n<p>\u201cSubsequently, a complaint was filed against the judge of IHC before the SJC, accompanied by an orchestrated media campaign to bring pressure to bear upon the judge to resign.\u201d<\/p>\n<p>The letter revealed that in May 2023, an IHC inspection judge reported to the chief justice that district court judges were being intimidated and crackers were thrown into the house of one additional district and sessions judge.<\/p>\n<p>The judge was even called to the IHC to verify the claims which he confirmed. But instead of probing the allegations, the judge \u201cwas made officer on special duty and transferred to IHC, before being sent back to Punjab as he was a judicial officer on deputation\u201d.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1799382\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>The letter said that last year, during routine maintenance, an IHC judge found that his official residence had been bugged with spy cameras concealed in his drawing room and bedroom.<\/p>\n<p>When data from surve\u00adillance equipment was rec\u00adovered, it showed that \u201cpr\u00adi\u00advate videos of the judge and his family members\u201d were stored. \u201cThe matter was brought to the attention of the IHC chief justice. There has been no determination of who installed the equipment and who is to be held accountable\u2026\u201d, the letter added.<\/p>\n<p>Along with their letter to the SJC, the six judges also attached copies of letters written to Justice Farooq on May 10, 2023 and Feb 12, 2024.<\/p>\n<p>The letters mentioned, among other complaints, ISI officials\u2019 efforts to pressurise IHC judges and probe into the tax records of at least one judge \u201cto seek a certain outcome\u201d.<\/p>\n<p>They added that it was imperative to determine whether there was a \u201cpolicy on the part of the executive \u2026 implemented by intelligence operatives\u201d to intimidate judges.<\/p>\n<p>\u201c[The] allegations of interference by operatives of ISI have been dealt with and relief has been granted to a former judge of IHC who was wronged. We believe that while such action was necessary, it may not be sufficient,\u201d the letter said about <a href=\"https:\/\/www.dawn.com\/news\/1823124\">Justice Siddiqui\u2019s case<\/a>.<\/p>\n<p>The judges noted that the SJC\u2019s code of conduct for judges did not outline the response to such incidents \u201cthat are tantamount to intimidation and interfere with judicial independence\u201d.<\/p>\n<p>They called for a judicial convention to discuss the interference of intelligence officials \u201cthat undermines independence of the judiciary\u201d.<\/p>\n<p>The consultation would help the Supreme Court to determine a course of action that judges could take \u201cwhen they find themselves at the receiving end\u201d, the letter said.<\/p>\n<\/p><\/div>\n<p><script async src=\"\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Calls emerged from various quarters on Wednesday for a probe into allegations made by six Islamabad High Court (IHC) judges against interference in judicial affairs by the country\u2019s intelligence apparatus.
