the trial under the 1979 judgment that sent former prime minister Zulfikar Ali Bhutto to the <a href=\"https:\/\/www.dawn.com\/news\/1160422\">gallows<\/a> did not meet the requirements of a \u201cfair trial and due process\u201d.<\/p>\n<p>Headed by Chief Justice of Pakistan (CJP) Qazi Faez Isa, a nine-judge bench announced its much-anticipated opinion on the long-pending <a href=\"https:\/\/www.dawn.com\/news\/617944\/reference-filed-in-sc-for-review-of-bhutto-case\">presidential reference<\/a> to answer whe\u00adther it can revisit its verdict, which the PPP and jurists regard as a historic wrong.<\/p>\n<p>Headed by CJP Isa, the larger bench consisted of Justice Sardar Tariq Masood, Justice Syed Mansoor Ali Shah, Justice Yahya Afridi, Justice Amin-ud-Din Khan, Justice Jamal Khan Mandokhel, Justice Muhammad Ali Mazhar, Justice Syed Hasan Azhar Rizvi and Justice Musarrat Hilali.<\/p>\n<p>The proceedings were broadcast live on the Supreme Court\u2019s <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/www.supremecourt.gov.pk\/court-proceedings\/\">website<\/a> and <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/www.youtube.com\/watch?v=xVHE-F62J3M\">YouTube<\/a> channel.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>The reference filed in April 2011 on behalf of former president Asif Ali Zardari sought an opinion under the Supreme Court\u2019s advisory jurisdiction on revisiting the death sentence awarded to the PPP founder.<\/p>\n<p>Announcing the unanimous opinion today, CJP Isa said, \u201cThe proceedings of the trial by the Lahore High Court and of the appeal by the Supreme Court of Pakistan do not meet the requirements of the fundamental right to a fair trial and due process enshrined in Articles 4 and 9 of the Constitution, and later guaranteed as a separate and fundamental right under Article 10A of the Constitution.\u201d<\/p>\n<p>A detailed opinion will be issued later by the SC.<\/p>\n<p>The SC acknowledged that there had been \u201csome cases in our judicial history that created a public perception that either fear or favour deterred the performance of a duty to administer justice in accordance with the law\u201d.<\/p>\n<p>\u201cWe must therefore be willing to confront our past missteps and fallibilities with humility, in the spirit of self-accountability, and as a testament to our commitment to ensure that justice must be served with unwavering integrity and fidelity to the law,\u201d Justice Isa said.<\/p>\n<p>\u201cWe cannot correct ourselves and progress in the right direction until we acknowledge our past mistakes,\u201d he added.<\/p>\n<p>The CJP stated that the SC was empowered to render an opinion on any \u201cquestion of law\u201d of public importance under Article 186 of the Constitution.<\/p>\n<p>The chief justice said that the reference provided an opportunity to \u201creflect upon the proceedings of the trial, conviction and death sentence of Mr Bhutto under the regime of military dictator General Ziaul Haq\u201d.<\/p>\n<p>He recalled that the reference was filed during the government of the PPP and that the successive governments of other major political parties \u201ccarried forward this inquiry and did not opt to withdraw the reference, which included the [\u2026] caretaker government\u201d.<\/p>\n<p>Noting that the reference had asked five questions, the CJP read out the opinion to one of those: \u201cThe Constitution and the law do not provide a mechanism to set aside the judgment whereby Bhutto was convicted and sentenced.\u201d<\/p>\n<p>Referring to a question asked on the principle of law, the SC said, \u201cReferenced questions do not specify the principle of law enunciated by this court in the Zulfikar Ali Bhutto case, regarding which our opinion is sought. Therefore, it cannot be answered whether any principle of law enunciated in Zulfikar Ali Bhutto case has been dissented to or overruled\u201d.<\/p>\n<p>On the question of whether the awarding and maintaining of the death sentence was \u201cjustified or could amount to deliberate murder\u201d, CJP Isa observed: \u201cThis court cannot reappraise the evidence and undo the decision of the case. However, in our detailed reasons, we shall identify the major constitutional and legal lapses hat had occurred with regard to fair trial and due process.\u201d<\/p>\n<p>About the matter of Islamic injunctions, the apex court said it would not render any assistance on the question. \u201cTherefore, it would be inappropriate to render an opinion on the Islamic aspects,\u201d it added.<\/p>\n<h2><a id=\"bhutto-family-hails-historic-opinion-44-years-later\" href=\"#bhutto-family-hails-historic-opinion-44-years-later\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>Bhutto family hails \u2018historic\u2019 opinion 44 years later<\/h2>\n<p>As the opinion was read out, the late Bhutto\u2019s grandson, Bilawal Bhutto-Zardari \u2014 clad in a black shalwar kameez and dark blue jacket \u2014 solemnly stood alongside his lawyer Farooq H. Naek and Raza Rabbani, and could be seen wiping his face with a handkerchief.<\/p>\n<p><figure class=\"media  sm:w-full  w-full  media--stretch  \"><figcaption class=\"media__caption  \">Bilawal Bhutto-Zardari speaks to media outside the Supreme Court. \u2014 DawnNewsTV<\/figcaption><\/figure>\n<\/p>\n<p>He later emerged from the courtroom with sunglasses on and briefly spoke to reporters. The PPP chairman called the court\u2019s views \u201chistoric\u201d, adding that they were awaiting the detailed opinion.<\/p>\n<p>He hoped that, 44 years later, the SC\u2019s opinion would allow Pakistan to progress, and that the \u201csystem\u201d would finally be put on the right path.<\/p>\n<p>\u201cThe stain of this decision made it difficult for the people of Pakistan to have faith in the court, and get justice from this court, especially if someone like the prime minister did not get justice,\u201d Bilawal said. He thanked the judges and amici curiae for hearing and fighting the case.<\/p>\n<p>In a <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/twitter.com\/BBhuttoZardari\/status\/1765281795417706802\/\">post on X<\/a>, Bilawal noted that the SC\u2019s opinion came \u201c44 years after judicial murder and more than 12 years after [the] presidential reference was filed\u201d.<\/p>\n<p>\u201cThe pursuit of justice was a labour of love by President Asif Ali Zardari in the name of his wife Shaheed <em>Mohtarma<\/em> Benazir Bhutto. Our family waited 3 generations to hear these words.\u201d<\/p>\n<p>His sister Bakhtawar Bhutto-Zardari <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/twitter.com\/BakhtawarBZ\/status\/1765272005153038539\">said<\/a> the apex court \u201cunanimously concludes that our grandfather was a victim of an unfair trial\u201d. She thanked her father for \u201cfiling [the] reference to correct history\u201d.<\/p>\n<p>Their sister Aseefa Bhutto-Zardari said her grandfather\u2019s \u201cblood stains the steps of the Supreme Court\u201d.<\/p>\n<p>In a post on X, she called it \u201ca permanent reminder of the grave injustice that weighs heavily on those hallowed halls\u201d. \u201cOver four decades later, justice has finally prevailed,\u201d Aseefa added.<\/p>\n<p>Prime Minister Shehbaz Sharif congratulated the PPP leadership and workers, stating that the SC\u2019s opinion \u201cset a new history and tradition\u201d, <em>APP<\/em> reported.<\/p>\n<h2><a id=\"case-history\" href=\"#case-history\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>Case history<\/h2>\n<p>In March 1979, nearly two years after the Bhutto\u2019s government\u2019s ouster by the then-military dictator Gen Ziaul Haq, a seven-judge SC bench, in a split four-three verdict, upheld the LHC\u2019s verdict awarding death sentence to the former premier.<\/p>\n<p>In April 2011, then-president Zardari filed a reference under Article 186 (1 and 2) of the Constitution, which empowers the president to refer any question of public importance to the apex court to seek its opinion on any matter.<\/p>\n<p>On Oct 9, 2018, Bilawal requested the SC to allow him to become a party in the case, stating that Bhutto was brutally executed as a consequence of a stroke of a pen, the 10-page application drafted by Naek stated.<\/p>\n<p>In December last year, the apex court <a href=\"https:\/\/www.dawn.com\/news\/1797219\">took up<\/a> the reference, regretting the delay in the fixing of the same.<\/p>\n<p>In January, the PPP had <a href=\"https:\/\/www.dawn.com\/news\/1803833\">submitted additional evidence<\/a> consisting of transcripts and video recordings of various interviews.<\/p>\n<p>In a subsequent hearing, the SC <a href=\"https:\/\/www.dawn.com\/news\/1804359\">observed<\/a> it could revisit its earlier judgments if it is established that a great miscarriage of justice occurred due to the departure from the Constitution or political elements in the prosecution.<\/p>\n<p>Senior counsel Makhdoom Ali Khan, appointed amicus curiae by the court, had said the present matter was a unique case in the common law jurisdiction where a judge, who was part of the narrowest majority of the bench, gave an interview much after his retirement.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1815889\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>In its Feb 21 hearing, CJP Isa <a href=\"https:\/\/www.dawn.com\/news\/1815889\">wondered<\/a> whether revisiting the case would enhance the reputation of the armed forces and \u201cheal the wounds\u201d of the nation. Justice Jamal Khan Mandokhel observed this could be an opportunity to put an end to interference in court matters from outside.<\/p>\n<p>The apex court also <a href=\"https:\/\/www.dawn.com\/news\/1817433\">found it \u201cinappropriate\u201d<\/a> of then-LHC chief justice Mushtaq Hussain to ask the then-Justice Dr Nasim Hasan Shah to sit in the SC bench hearing the challenge to his order of awarding death to Bhutto.<\/p>\n<p>During another hearing, retired SC Justice Manzoor Malik pointed out <a href=\"https:\/\/www.dawn.com\/news\/1817673\/ex-sc-judge-points-out-glaring-loopholes-in-za-bhutto-case\">harrowing illegalities<\/a> in the ex-PM\u2019s trial. Justice Sardar Tariq Masood deplored that it was quite clear that there was no order of confirmation of the death sentence by the high court.<\/p>\n<p>Continuing his arguments as amicus curiae, Justice Malik had urged the top court to <a href=\"https:\/\/www.dawn.com\/news\/1817908\/sc-asked-to-rectify-miscarriage-of-justice-in-zulfikar-ali-bhutto-case\">rectify the miscarriage of justice<\/a> or simply brush it aside on technical grounds.<\/p>\n<p>During the closing of the reference hearing on Monday, CJP Isa had <a href=\"https:\/\/www.dawn.com\/news\/1819195\/apex-court-to-issue-bhutto-case-short-order-in-two-days\">observed<\/a> that the court would announce a short order on the reference in a couple of days after consultation since one of the bench members, Justice Sardar Tariq Masood, is retiring soon.<\/p>\n<p>Ahmed Raza Qasuri, on whose complaint the murder case was registered against former PM Bhutto, pointed out that the court had not crossed the hurdle of admissibility of the reference and feared that any opinion by the apex court would open up the floodgates of references inundating the court with a tsunami of cases like the <a href=\"https:\/\/www.dawn.com\/news\/1805488\">Jan 13 denial<\/a> of \u2018bat\u2019 symbol to the PTI.<\/p>\n<\/p><\/div>\n<p><script async src=\"\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court on Wednesday observed that the trial under the 1979 judgment that sent former prime minister Zulfikar Ali Bhutto to the gallows did not meet the requirements of a \u201cfair trial and due process\u201d.
