{"id":5321,"date":"2023-09-18T14:50:15","date_gmt":"2023-09-18T14:50:15","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/lawyers-journalists-weigh-in-on-scs-first-live-broadcast\/"},"modified":"2023-09-18T14:50:15","modified_gmt":"2023-09-18T14:50:15","slug":"lawyers-journalists-weigh-in-on-scs-first-live-broadcast","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/lawyers-journalists-weigh-in-on-scs-first-live-broadcast\/","title":{"rendered":"Lawyers, journalists weigh in on SC\u2019s first live broadcast"},"content":{"rendered":"<p><\/p>\n<p>&#8220;Our judiciary needs to take to embrace the digital age and use technology to make courts and justice more accessible,&#8221; said lawyer Jibran Nasir.<\/p>\n<div dir=\"auto\">\n<p>Chief Justice of Pakistan (CJP) Qazi Faez Isa\u2019s first day as the country\u2019s top judge started off with <a href=\"https:\/\/www.dawn.com\/news\/1776540\/in-a-first-sc-broadcasts-proceedings-live-with-cjp-isa-presiding-over-full-court-hearing\">a full court hearing<\/a> on a set of petitions challenging the Supreme Court (Practice and Procedure) Act 2023. What sets this hearing apart is that it is being <a href=\"https:\/\/www.dawn.com\/news\/1776540\/in-a-first-sc-broadcasts-proceedings-live-with-cjp-isa-presiding-over-full-court-hearing\">broadcast live<\/a> on the CJP\u2019s orders \u2014 a first in Pakistan\u2019s judicial history.<\/p>\n<p>The Act was passed in parliament earlier this year in an attempt to regulate the CJP\u2019s powers, requiring the formation of benches on constitutional matters of public importance by a committee of three senior judges of the court. The committee would also decide whether or not to take up a matter on <em>suo motu<\/em>, which was previously the CJP\u2019s sole prerogative.<\/p>\n<figure class=\"media  w-full  w-full  media--stretch  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1748007\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>The live broadcast is considered a welcome step by many among the legal, journalist and even political fraternities.<\/p>\n<h2><a id=\"mini-revolution\" href=\"#mini-revolution\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>\u2018Mini-revolution\u2019?<\/h2>\n<p>Journalist and political analyst Mazhar Abbas termed the live coverage a \u201cmini-revolution\u201d in the SC. He cautioned, however, that the \u201creal judicial revolution can only come through drastic reforms. Justice must be seen to be done.\u201d<\/p>\n<p>PPP Senator Sehar Kamran took to X (formerly Twitter ) to state that a \u201cnew era begins at the Supreme Court of Pakistan\u201d. However, she pointed out that beyond symbolic gestures, it was crucial to delve deeper and observe how these traditions evolve to uphold justice and the rule of law.<\/p>\n<p>Journalist Asma Shirazi referred to the hearing and live broadcast as \u201chistory in [the] making\u201d.<\/p>\n<p>Journalist and analyst Fahd Hussain said the live broadcast symbolises new ground being broken: \u201cExpressions, tones, emotion, faces, diction, logic, questions \u2014 everything under intense public scrutiny. Optics may take centre stage in centre court.\u201d<\/p>\n<h2><a id=\"technology-transparency-and-accessibility\" href=\"#technology-transparency-and-accessibility\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>Technology, transparency and accessibility<\/h2>\n<p>Lawyer and managing partner at The Crown Law Chambers Abuzar Salman Niazi expressed the belief that live streaming is a \u201cbrilliant step towards transparency, access to justice, openness and also education\u201d. He also pointed out the importance of Urdu translations to make the hearings more accessible to the public.<\/p>\n<p>Lawyer and central legal coordinator for Pakistan Tehreek-i-Insaf (PTI) remarked: \u201cSupreme Court live! Bravo new world. Pakistan finally entered into the era of technology.\u201d<\/p>\n<p>Lawyer and activist Jibran Nasir argued that live broadcast of SC hearings, especially on important constitutional matters, is a \u201cproper and right decision by CJP Isa\u201d.<\/p>\n<p>\u201cThe judges are there to serve the people hence their conduct and actions should be transparent.\u201d He added that this would make the judges more accountable and also \u201ccuts out the unnecessary drama created by reporters about judges and court proceedings as the people can see what happens for themselves\u201d.<\/p>\n<p>\u201cOur judiciary needs to take to embrace the digital age and use technology to make courts and justice more accessible,\u201d said Nasir.<\/p>\n<p>Nasir also said that Justice Isa had shown, unlike his predecessors, that he was not scared of dissent from his colleagues: \u201cUnder the previous CJP dissenting notes would be deleted from the Supreme Court website and today the new CJP wants entire proceedings to be in public knowledge.\u201d<\/p>\n<p>Journalist and President of <em>Samaa TV<\/em>, Nadeem Malik, said that CJP Isa was rewriting history books by showing SC proceedings live. Like Nasir, Malik also pointed to the lack of transparency by previous CJPs: \u201cMany former CJs failed to ensure transparency &amp; justice \u2026 Let\u2019s make it a law to show all proceedings of the Supreme Court and high courts on dedicated channels.<\/p>\n<p>\u201cIt would go a long way to discourage injustice and eliminate compromise of the judicial system.\u201d<\/p>\n<h2><a id=\"a-step-in-the-wrong-direction\" href=\"#a-step-in-the-wrong-direction\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>\u2018A step in the wrong direction\u2019<\/h2>\n<p>Barrister Gohar Khan, however, termed the live stream \u201ca step in the wrong direction\u201d with no further comment.<\/p>\n<p>Journalist Hasan Zaidi, meanwhile, pointed out that streaming the hearing is \u201ca great expose of the mediocrity rampant in the legal profession garbed in \u2018respectable\u2019 suits.\u201d<\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>&#8220;Our judiciary needs to take to embrace the digital age and use technology to make courts and justice more accessible,&#8221; said lawyer Jibran Nasir.
