{"id":5209,"date":"2023-09-18T07:38:04","date_gmt":"2023-09-18T07:38:04","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/hearing-of-sc-practice-and-procedure-act-being-broadcast-live\/"},"modified":"2023-09-18T07:38:04","modified_gmt":"2023-09-18T07:38:04","slug":"hearing-of-sc-practice-and-procedure-act-being-broadcast-live","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/hearing-of-sc-practice-and-procedure-act-being-broadcast-live\/","title":{"rendered":"Hearing of SC Practice and Procedure Act being broadcast live\u00a0"},"content":{"rendered":"<div>\n            <!-- image --><\/p>\n<div class=\"td-post-featured-image\"><a href=\"https:\/\/arynews.tv\/wp-content\/uploads\/2023\/09\/CJPPPPP.jpg\" data-caption=\"\"><\/a><\/div>\n<p>            <!-- content --><\/p>\n<p class=\"\"><strong>ISLAMABAD: A full court bench headed by Chief Justice Qazi Faez Isa is hearing petitions challenging the Supreme Court (Practice and Procedure) Act, 2023 \u2013 a legislation introduced by the former coalition government.<\/strong><\/p>\n<p><div class=\"ast-oembed-container \" style=\"height: 100%;\"><iframe title=\"ARY NEWS LIVE | Latest Pakistan News \ud835\udfd0\ud835\udfd2\/\ud835\udfd5 | Headlines, Bulletins, Breaking News\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/sUKwTVAc0Vo?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/div>\n<p>The proceedings of the case are being broadcast live on state television PTV.<\/p>\n<p class=\"\">Earlier, the Supreme Court decided that the full court proceedings on a set of pleas challenging the Supreme Court (Practice and Procedure) Act 2023 would be broadcast live.<\/p>\n<p>The decision was taken in a full court meeting headed by CJP Justice Qazi Faez Isa.<\/p>\n<p>The full court was constituted by newly-appointed Chief Justice of Pakistan Qazi Faez Isa and includes Justice Sardar Tariq Masood, Justice Ijazul Ahsan, Justice Syed Mansoor Ali Shah, Justice Munib Akhtar, Justice Yahya Afridi, Justice Aminuddin Khan, Justice Sayyed Mazahar Ali Akbar Naqvi, Justice Jamal Khan Mandokhel, Justice Muhammad Ali Mazhar, Justice Ayesha A. Malik, Justice Athar Minallah, Justice Syed Hasan Azhar Rizvi, Justice Shahid Waheed and Justice Musarrat Hilali.<\/p>\n<p>Following the decisions the cameras of PTV were installed in the courtroom for the broadcast of the hearing live.<\/p>\n<p>Four cameras have also been installed in the visitors\u2019 gallery and one is installed for the lawyers\u2019 rostrum in front of the judges\u2019 docks.<\/p>\n<p><em><strong>Read more: <a title=\"Jazeela Aslam: CJP Isa appoints first-ever woman SC Registrar\" href=\"https:\/\/arynews.tv\/jazeela-aslam-cjp-isa-appoints-first-ever-woman-sc-registrar\/\" rel=\"bookmark\">Jazeela Aslam: CJP Isa appoints first-ever woman SC Registrar<\/a><\/strong><\/em><\/p>\n<h4><strong>Hearing\u00a0<\/strong><\/h4>\n<p>At the outset of the hearing, the Supreme Court accepted all the pleas seeking the formation of the full court to hear the case. CJP Qazi Faez Isa remarked there were three petitions for the constitution of the full court and the best solution to address this important issue.<\/p>\n<p>The federal government in its response submitted to the SC, urged the apex court to dismiss all the pleas challenging SC Practice and Procedure Act. \u201cPleas against the law passed by Parliament are inadmissible.\u201d<\/p>\n<p>Parliament has the right to legislation under Article 191 of the Constitution of Pakistan, the written reply of the government read and added that no one can bar the Parliament from legislation.<\/p>\n<p>The petitioner\u2019s lawyer, Khawaja Tariq Rahim in his arguments said the Parliament cannot interfere in SC\u2019s matters. To, this the CJP remarked, \u201cWhatever you are saying is not mentioned in the act.\u201d<\/p>\n<p>Khawaja sahab! don\u2019t go in the past, read the act which you have challenged, CJP Isa asked.<\/p>\n<p>Justice Athar Minallah remarked Khawaja sahab are you in favour of giving all the powers to a single personality? Whatever happened in the past, do you want it to continue? he added.<\/p>\n<p class=\"\"><em><strong>Read more: <a href=\"https:\/\/arynews.tv\/cjp-qazi-faez-isa-asks-judicial-staff-to-serve-people-seeking-justice\/\">CJP Qazi Faez Isa asks judicial staff to serve people seeking justice<\/a><\/strong><\/em><\/p>\n<h4><strong>CJP welcomed upon arrival at SC<\/strong><\/h4>\n<p>Earlier, Chief Justice of Pakistan (CJP) Justice Qazi Faez Isa received a warm welcome from the staff upon his arrival at the Supreme Court.<\/p>\n<p>Justice Qazi Faez Isa took oath as the 29th CJP in a ceremony held at the President\u2019s House on Sunday.<\/p>\n<p>In his interaction with the\u00a0<a href=\"https:\/\/arynews.tv\/jazeela-aslam-cjp-isa-appoints-first-ever-woman-sc-registrar\/\">SC registrar<\/a>\u00a0and other judicial staff, CJP Qazi Faez Isa asked them to serve the masses coming to the court for justice.<\/p>\n<h4><strong>The law<\/strong><\/h4>\n<p>The legislation limits the powers of the Chief Justice of Pakistan to take suo motu notice and to constitute benches on his own.
