{"id":46917,"date":"2024-01-12T08:34:04","date_gmt":"2024-01-12T08:34:04","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/sc-wont-take-over-ecps-job-cjp-isa-tells-pti-lawyer\/"},"modified":"2024-01-12T08:34:04","modified_gmt":"2024-01-12T08:34:04","slug":"sc-wont-take-over-ecps-job-cjp-isa-tells-pti-lawyer","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/sc-wont-take-over-ecps-job-cjp-isa-tells-pti-lawyer\/","title":{"rendered":"SC \u2018won\u2019t take over\u2019 ECP\u2019s job, CJP Isa tells PTI lawyer"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>Chief Justice of Pakistan (CJP) Qazi Faez Isa on Friday said that the Supreme Court would not \u201ctake over\u201d the job of the Election Commission of Pakistan (ECP), noting that it was a constitutional body.<\/p>\n<p>His remarks came as a three-member bench \u2014 comprising CJP Isa, Justice Muhammad Ali Mazhar and Justice Musarrat Hilali \u2014 took up the ECP\u2019s petition challenging the Peshawar High Court\u2019s (PHC) decision to restore the PTI\u2019s iconic \u2018bat\u2019 election symbol.<\/p>\n<p>Responding to PTI counsel Hamid Khan\u2019s arguments, Justice Isa noted that there was a \u201cvery clear line of demarcation\u201d between the functions of a constitutional and a statutory body.<\/p>\n<p>He remarked, \u201cIf they\u2019re (ECP) doing their job, we won\u2019t take over their job [or] how to do it [or] how better to do it.\u201d<\/p>\n<p>On December 22, the ECP had <a href=\"https:\/\/www.dawn.com\/news\/1800094\">decided against<\/a> letting PTI retain its electoral symbol for the general elections, saying that it had failed to hold intra-party polls as per its prevailing constitution and election laws.<\/p>\n<p>Subsequently, the PTI had approached the PHC against the ECP order on Dec 26 and a single-member bench <a href=\"https:\/\/www.dawn.com\/news\/1801017\/peshawar-high-court-hands-bat-back-to-pti\">restored<\/a> the electoral symbol of the party till January 9 and directed that the case be fixed before a divisional bench.<\/p>\n<p>On Dec 30, the electoral watchdog had <a href=\"https:\/\/www.dawn.com\/news\/1801894\">filed a review application<\/a> in the PHC, arguing that the court had overstepped its jurisdiction. Days later, in a major blow for the PTI, the high court had <a href=\"https:\/\/www.dawn.com\/news\/1802878\">withdrawn the stay<\/a> on the ECP order, stripping the party of its symbol again.<\/p>\n<p>Consequently, the PTI moved the Supreme Court against the restoration of the ECP ruling. On Wednesday, the party had withdrawn the appeal as the matter was already being heard by the PHC.<\/p>\n<p>The same day, the PHC had <a href=\"https:\/\/www.dawn.com\/news\/1804672\/pti-wins-back-bat-as-phc-declares-ecp-order-illegal\">declared<\/a> \u201cillegal\u201d the ECP\u2019s decision to revoke PTI\u2019s iconic \u2018bat\u2019 electoral symbol and reject its intra-party polls. In the short order, the PHC had termed the ECP order as \u201cillegal, without any lawful authority and of no legal effect\u201d.<\/p>\n<p>According to the court, the PTI was entitled to the election symbol \u201cstrictly in terms of sections 215 and 217, read with any other enabling provision of the Elections Act 2017 and Election Rules 2017\u201d.<\/p>\n<p>A day earlier, the ECP had challenged the PHC\u2019s decision to restore the PTI\u2019s election symbol. Simultaneously, the PTI <a href=\"https:\/\/www.dawn.com\/news\/1804976\/pti-moves-phc-seeking-contempt-proceedings-against-ecp-over-failure-to-implement-order-in-bat-case\">initiated<\/a> legal action in the PHC, filing a contempt petition against Chief Election Commissioner Sikandar Sultan Raja and other ECP members for not implementing the high court\u2019s order in the case.<\/p>\n<p>During today\u2019s hearing, Hamid appeared as the PTI counsel while Makhdoom Ali Khan was present as the ECP lawyer.<\/p>\n<p>Akbar S. Babar, an estranged party member, also appeared before the court whereas PTI lawyer Ali Zafar attended the hearing via video link from the SC\u2019s Lahore registry.<\/p>\n<p>Gohar Ali, who was elected as the PTI chairman in the recent intra-party polls, reached the SC as well as the party\u2019s chief election commissioner (CEC) Niazullah Niazi and lawyer Shoaib Shaheen.<\/p>\n<p>The hearing has been adjourned till 1:30pm.<\/p>\n<h2><a id=\"the-hearing\" href=\"#the-hearing\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>The hearing<\/h2>\n<p>At the outset of the hearing, the ECP counsel came to the rostrum. When CJP Isa asked Makhdoom whether the PHC\u2019s written order had been issued or not, the latter replied that it had not been.<\/p>\n<p>The lawyer then read out the PHC order that restored the PTI\u2019s \u2018bat\u2019 symbol. He said that the ECP had not yet received \u201cany notice\u201d of the PHC order, to which the chief justice said, \u201cI have not read the case file either.\u201d<\/p>\n<p>The top judge asked Makhdoom when he would be ready to present the case, at which the counsel urged the SC to adjourn the hearing till Monday. Makhdoom further said that the political parties would be allotted electoral symbols tomorrow.<\/p>\n<p>Here, the CJP observed that to adjourn the hearing till Monday, the PHC\u2019s recent verdict would have to be suspended, adding that the apex court was ready to hear the case on Saturday and Sunday as well. The ECP lawyer then sought time till tomorrow to prepare for the case.<\/p>\n<p>Makhdoom recalled that the PTI was supposed to hold its intra-party polls in 2022 and that the electoral watchdog issued a notice to the PTI for not holding the intra-party polls according to its party constitution.<\/p>\n<p>Here, Justice Mazhar asked about the process for appointing the party\u2019s CEC mentioned in the PTI\u2019s constitution, to which the ECP lawyer said that Jamal Ansari was the previous party CEC, after which Niazi took the role.<\/p>\n<p>Upon the chief justice asking who were the other members of the PTI\u2019s election commission, Makhdoom said \u201cno member other than the CEC was appointed\u201d.<\/p>\n<p>However, when the CJP asked Hamid if the same was true, the PTI counsel answered it was not. The top judge then inquired about the documents pertaining to the appointment of members of the PTI\u2019s electoral body.<\/p>\n<p>Here, the PTI lawyer said he had sought time to prepare for the case, adding that he would present arguments on the ECP\u2019s appeal not being maintainable and not having the right to claim.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1800094\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>Makhdoom argued that the constitution of the PTI\u2019s election commission for the intra-party polls was \u201cnot legally correct\u201d. When CJP Isa asked Hamid if the ECP counsel\u2019s claim was true, he replied in the negative.<\/p>\n<p>Here, the PTI lawyer reiterated that the ECP\u2019s appeal was not maintainable, at which the chief justice directed him to present his arguments first.<\/p>\n<p>Hamid contended that the electoral watchdog could not file an appeal in the apex court as a \u201crespondent has to file an appeal, not the election commission\u201d.<\/p>\n<p>Justice Isa asked whether the ECP could not \u201cdefend its orders\u201d, to which the PTI counsel raised the question: \u201cCan a judge file an appeal against its own verdict?\u201d<\/p>\n<p>At one point during the hearing, CJP Isa observed, \u201cThe election commission is not just a quasi-judicial body. It is a constitutional body.\u201d<\/p>\n<p>\u201cIt has two functions; one [is] regulating the affairs of political parties, which is an ongoing exercise, and the other is free and fair elections,\u201d he added.<\/p>\n<p>The chief justice said that customs collectors could also file appeals against their verdicts in high courts, remarking that the question of maintainability would then also arise on the PTI\u2019s appeal before the PHC.<\/p>\n<p>Hamid reiterated that an affected party could appeal verdicts but not the ECP, asking if a district judge could challenge its order being struck down. To this, Justice Isa noted that district judges were subordinate to the judiciary whereas the electoral watchdog was a \u201cseparate constitutional body\u201d.<\/p>\n<p>The PTI lawyer then referred to a past judgment where he said the SC had prevented a commission and the federal ombudsman from appealing their decisions, at which the top judge asked if such verdicts could be applied to constitutional bodies.<\/p>\n<p>\u201cInstitutions constituted under the law and the Constitution cannot be alike. The election commission formed under the Constitution would use its powers according to the Constitution,\u201d the CJP observed.<\/p>\n<p>Here, Hamid contended that the ECP was not emphasising the Constitution but rather the Elections Act 2017.<\/p>\n<p>\u201cThis will amount to virtually finishing off the Constitutional body,\u201d the chief justice remarked, adding that the PTI counsel was making a \u201cvery hypotechnical argument\u201d for which he had no precedent.<\/p>\n<p>Justice Isa noted that there was a \u201cvery clear line of demarcation\u201d between the functions of a constitutional body and a statutory one, which he said was a \u201csub-constitutional body functioning under a statute\u201d.<\/p>\n<p>He remarked, \u201cIf they\u2019re (ECP) doing their job, we won\u2019t take over their job [or] how to do it [or] how better to do it.\u201d<\/p>\n<p>CJP Isa then again asked about the whereabouts of the documents about the appointments of PTI\u2019s election commission members and sought the complete record of the case proceedings from the ECP.<\/p>\n<p>In his arguments, Makhdoom, the ECP lawyer, stated that the commission had received 14 complaints against the PTI\u2019s intra-party polls. When asked who had filed them, the counsel replied that the petitioners were PTI members.<\/p>\n<p>At this point during the hearing, Babar\u2019s counsel, Ahmed Hasan, came to the rostrum and told the court that his client was a founding member of the PTI and had served at \u201cvarious positions\u201d in the party.<\/p>\n<p>The CJP wondered, \u201cThen why is he not a PTI member?\u201d, asking Hamid whether Babar had been expelled from the party. Justice Mazhar noted, \u201cIn my view, a founding member does not ever stop being one.\u201d<\/p>\n<p>The top judge also asked if Babar had joined another political party, to which the PTI counsel said, \u201cThis is a separate discussion that who is a founding member and who is not.\u201d<\/p>\n<p>When the chief justice asked Hamid if he was a founding member of the party, the lawyer replied that he was.<\/p>\n<p>Babar\u2019s counsel argued that the Islamabad High Court had declared that his client was a PTI member.<\/p>\n<p>CJP Isa then wondered whether the PTI\u2019s intra-party polls were held uncontested, responding to which the ECP lawyer said that there used to be three panels before but then an \u201cannouncement was made that all people have resigned and the elections were held uncontested\u201d.<\/p>\n<p>Makhdoom further added that there was no competition for any party position. Here, Justice Isa asked who Niazullah Niazi was, at which he came to the rostrum.<\/p>\n<p>The top judge asked Niazi whether he thought that everyone being elected without contest was a \u201cweird coincidence\u201d. The PTI member stated that all position-holders of the party were elected without contest.<\/p>\n<h2><a id=\"phc-seeks-ecp-response-by-jan-16\" href=\"#phc-seeks-ecp-response-by-jan-16\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>PHC seeks ECP response by Jan 16<\/h2>\n<p>Meanwhile, the PHC sought a response from the ECP on a <a href=\"https:\/\/www.dawn.com\/news\/1804976\/pti-moves-phc-seeking-contempt-proceedings-against-ecp-over-failure-to-implement-order-in-bat-case\">contempt plea<\/a> filed by the PTI for not implementing the court\u2019s <a href=\"https:\/\/www.dawn.com\/news\/1804672\/pti-wins-back-bat-as-phc-declares-ecp-order-illegal\">January 10 order<\/a> that reinstated the party\u2019s electoral symbol.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1805148\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>The petition had stated that the election commission had not \u201cissued the certificate to PTI on its website\u201d despite the high court\u2019s directives, which amounted to contempt of court.<\/p>\n<p>The party had accused the respondents of not \u201cmoving an inch\u201d for the implementation of the PHC order and that they \u201cwillfully disobeyed the same\u201d.<\/p>\n<p>Today, Justice Shakeel Ahmed and Justice Waqar Ahmed presided over the hearing, during which Advocates Qazi Anwar and Shah Faisal Ilyas appeared before the court.<\/p>\n<p>Subsequently, the court issued a notice to the ECP CEC and the secretary and sought a response on the implementation of its orders by January 16.<\/p>\n<h2><a id=\"ecp-petition\" href=\"#ecp-petition\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>ECP petition<\/h2>\n<p>The ECP\u2019s petition, submitted by former attorney general Makhdoom Ali Khan, argued that the PHC should not have proceeded with the case without first issuing a notice to the attorney general for Pakistan (AGP).<\/p>\n<p>This procedural step was necessary because the legal question at hand pertained to the federal government, involving the interpretation of Article 17 of the Constitution and its relationship with the provisions of the Elections Act of 2017, it said.<\/p>\n<p>The petition also highlighted that the PHC\u2019s order conflicted with previous Supreme Court rulings, which have consistently discouraged high courts from intervening in the electoral process, which, as per the Constitution, was exclusively within the ECP\u2019s jurisdiction.<\/p>\n<p>The petition emphasised that the high court\u2019s judgement effectively nullified key sections of the Elections Act and Election Rules by restricting the ECP\u2019s constitutional and statutory roles in regulating and supervising intra-party elections of political parties. This interpretation contradicted the principles established in previous superior court rulings, it said.<\/p>\n<p>Furthermore, it undermined the fundamental purpose of Section 215(5) of the Act, in conjunction with Rules 157 and 158, which aim to foster democracy, pluralism, and transparency within political parties by ensuring timely intra-party elections, it added.<\/p>\n<p>Additionally, the PHC ruling disregarded the essence of Section 208(2) of the Elections Act, which is intended to guarantee equal opportunities for all party members to contest elections for any political party office.<\/p>\n<p>It said the high court order not only rendered relevant provisions practically redundant but also enabled a political party to undertake \u201csham\u201d intra-party elections without any checks and balances.
