{"id":46075,"date":"2024-01-10T08:16:04","date_gmt":"2024-01-10T08:16:04","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/bat-symbol-case-pti-hopes-for-relief-from-phc-after-withdrawing-plea-from-sc\/"},"modified":"2024-01-10T08:16:04","modified_gmt":"2024-01-10T08:16:04","slug":"bat-symbol-case-pti-hopes-for-relief-from-phc-after-withdrawing-plea-from-sc","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/bat-symbol-case-pti-hopes-for-relief-from-phc-after-withdrawing-plea-from-sc\/","title":{"rendered":"\u2018Bat\u2019 symbol case: PTI hopes for relief from PHC after withdrawing plea from SC"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>The Peshawar High Court (PHC) is currently hearing the PTI\u2019s petition against the Election Commission of Pakistan\u2019s <a href=\"https:\/\/www.dawn.com\/news\/1800094\">order<\/a> revoking the party\u2019s \u2018bat\u2019 electoral symbol and declaring its intra-party polls \u201cunconstitutional\u201d.<\/p>\n<p>The hearing is taking place shortly after the party withdrew from the Supreme Court its appeal seeking the restoration of its electoral symbol. Speaking to the media outside the court, PTI leader Barrister Gohar said that the case in the PHC was heard all day yesterday and the hearing had been adjourned till today.<\/p>\n<p>He said the PHC had stated that today, likely before 11am, an order would be issued.<\/p>\n<p>\u201cKeeping this in mind, the petition we had filed in the SC against the [PHC\u2019s] interim order became infructuous [\u2026] Because the verdict in the main case is expected at any time today [\u2026] we have withdrawn the plea from the SC,\u201d Gohar said.<\/p>\n<p>He said that the PHC would issue the final verdict, saying, \u201cWe hope that the verdict will be based on justice and rights and that we will get the \u2018bat\u2019 symbol.\u201d<\/p>\n<p>On December 22, the Election Commission of Pakistan had <a href=\"https:\/\/www.dawn.com\/news\/1800094\">decided<\/a> against letting PTI retain its electoral symbol for the February 8 election, saying that it had failed to hold <a href=\"https:\/\/www.dawn.com\/news\/1794477\">intra-party polls<\/a> in accordance with its prevailing constitution and election laws.<\/p>\n<p>The PTI had approached the PHC against the ECP order on Dec 26 and a single-member bench <a href=\"https:\/\/www.dawn.com\/news\/1801017\/peshawar-high-court-hands-bat-back-to-pti\">restored<\/a> the electoral symbol of the party till January 9.<\/p>\n<p>On Dec 30, the electoral watchdog had <a href=\"https:\/\/www.dawn.com\/news\/1801894\">filed<\/a> a review petition in the PHC, <a href=\"https:\/\/www.dawn.com\/news\/1802782\/court-overstepped-jurisdiction-in-bat-case-ecp-lawyer\">arguing<\/a> that the court had overstepped its jurisdiction. Days later, in a <a href=\"https:\/\/www.dawn.com\/news\/1802878\">major blow<\/a> for the PTI, the high court had restored the ECP order, stripping the party of its symbol again. Subsequently, the PTI <a href=\"https:\/\/www.dawn.com\/news\/1803323\">moved<\/a> the Supreme Court against the restoration of the ECP ruling.<\/p>\n<p>A day earlier, PTI counsel Barrister Ali Zafar had <a href=\"https:\/\/www.dawn.com\/news\/1804404#:~:text=reason%2C%E2%80%9D%20it%20said.-,PHC,-hearing%20on%20PTI\">argued<\/a> before the PHC that the electoral watchdog was \u201conly a record keeper\u201d and did not have the power to \u201csnatch a party\u2019s electoral symbol\u201d.<\/p>\n<p>After marathon arguments advanced by lawyers representing the PTI and the ECP for almost five hours, the bench had adjo\u00adu\u00adrned the hearing till today.<\/p>\n<p>PHC\u2019s Justice Ejaz Anwar and Justice Syed Arshad Ali presided over today\u2019s hearing, where counsels of those challenging the PTI\u2019s intra-party polls were to present their arguments.<\/p>\n<p>The 15 respondents in the case comprise the ECP, Akbar S. Babar, Noureen Farooq Khan, Raja Tahir Nawaz Abbasi, Mehmood Ahmed Khan, Advocate Sabah Zahid, Raja Hamid Zaman Kiani, Muhammad Shah Fahad, Muhammad Muzammil Sandhu, Yousaf Ali, Bilal Azhar Rana, Jehangir Khan, Sardar Niaz Ahmad, Talib Hussain alias Chaudhry Tanveer and Shahid Yaqoob.<\/p>\n<h2><a id=\"will-approach-sc-if-justice-not-served-akbar-s-babar\" href=\"#will-approach-sc-if-justice-not-served-akbar-s-babar\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>\u2018Will approach SC if justice not served\u2019: Akbar S. Babar<\/h2>\n<p>As the PTI withdrew its petition before the SC, Babar, the party\u2019s estranged founding member, lamented that the PHC had not issued notices to \u201cfive important respondents\u201d.<\/p>\n<p><figure class=\"media  sm:w-1\/2  w-full  media--right  \"><figcaption class=\"media__caption  \">Akbar S. Babar speaks outside SC on Jan 10. \u2014 DawnNewsTV<\/figcaption><\/figure>\n<\/p>\n<p>Speaking outside the apex court, Babar said the parties would have presented evidence before the PHC of the \u201cPTI\u2019s fake intra-party polls\u201d if they had been made respondents in the case, recalling that 14 petitioners did the same before the SC.<\/p>\n<p>He asserted that the ECP had \u201cfull authority\u201d to make decisions regarding political parties and that the electoral watchdog was \u201cbeing prevented from fulfilling its duties instead of being strengthened\u201d.<\/p>\n<p>Babar said petitions were being filed before multiple high courts against the ECP and the \u201cPTI leaders had been robbed of their rights\u201d due to the \u201cfake intra-party polls held in a closed room\u201d.<\/p>\n<p>He further said the PTI lawyers were considering the election commission a \u201cpost office\u201d and asserted that there should be no interference in its functions.<\/p>\n<p>\u201cIf we do not get justice, we will approach the Supreme Court,\u201d Babar vowed, adding that there were documents stating that he was a PTI member. \u201cIf they want action against me, they may file a petition in court.<\/p>\n<p>He continued: \u201cIf the oppressor commits oppression, he is also oppressed. For three years, they did injustice. Now, the same is happening with them.\u201d<\/p>\n<p>Babar recalled that those <a href=\"https:\/\/www.dawn.com\/news\/1804610\/group-of-pti-kp-leaders-protests-sale-of-tickets\">protesting<\/a> a day ago in Islamabad against the \u201csale of party\u2019s tickets\u201d were also PTI workers.<\/p>\n<h2><a id=\"phc-hearing\" href=\"#phc-hearing\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>PHC hearing<\/h2>\n<p>At the outset of the hearing, Advocate Naveed Akhtar, the counsel for Jehangir from Charsadda, stated that the matter was also fixed for hearing before the SC.<\/p>\n<p>At this, Justice Anwar recalled that the PTI had said it would not pursue the matter there. Barrister Zafar also reassured the court about the same.<\/p>\n<p>Here, Advocate Qazi Jawwad, the counsel for Yousaf Ali, stated that his client had served as the party\u2019s district secretary general and wanted to contest the upcoming general elections but \u201cwas not given the chance\u201d.<\/p>\n<p>Justice Anwar observed that if the petitioner was challenging the PTI\u2019s intra-party elections, he should have sought that the polls be held again but did not do so.<\/p>\n<p>\u201cIf you were from the party, then you should have objected to revoking the party symbol but you did not do so,\u201d the PHC judge noted. The lawyer responded by reiterating that his client was not given a chance to take part in the intra-party polls.<\/p>\n<p>Jawwad argued that the PHC could only review provincial matters while the intra-party polls were held countrywide, to which Justice Anwar asked if the PTI should have approached all high courts. Justice Ali wondered why a case could not be filed in the high court if the elections were also held in Peshawar.<\/p>\n<p>Jawwad said that the Lahore High Court had dismissed a petition, to which Justice Anwar replied that the LHC had said the matter was sub judice before the PHC, hence it could not interfere.<\/p>\n<p>The judge asked if any intra-party polls had been held without an electoral symbol, to which Jawwad answered that there had been \u201cnon-party elections and even if parties were dissolved, new ones were created\u201d. At this, Justice Anwar remarked that the said events had taken place during martial law.<\/p>\n<p>The judge then inquired the counsel whether he thought the PTI should get its electoral symbol back, to which Jawwad said he \u201csupported action according to the law\u201d. He added that he wanted the intra-party polls to be held again.<\/p>\n<p>At this point during the hearing, Tariq Afridi, the counsel for Shah Fahad, began presenting his arguments before the PHC.<\/p>\n<p>He contended that the high court could not hear the matter as its jurisdiction had been stated in Article 199 (jurisdiction of high court) of the Constitution.<\/p>\n<p>Fahad\u2019s second counsel, Ahmed Farooq, also appeared before the court and said, \u201cAs soon as this party (PTI) was created, <em>laadlapan<\/em> (favouritism) began.\u201d Justice Anwar then directed him to restrict his arguments to legal points.<\/p>\n<p>Farooq argued that under the Elections Act 2017, it was not mandatory for a political party to get the same electoral symbol each time. \u201cIf two parties ask for the same symbol, then the ECP has the power\u201d to decide, he contended.<\/p>\n<p>The lawyer for petitioners Raja Tariq and Noureen Farooq, Mian Azizuddin, argued that after the PTI conducted intra-party polls, a certificate was not submitted to the ECP by an authorised person. He said his clients moved a petition against the intra-party polls, which was then sent to the ECP.<\/p>\n<p>In his arguments, Akhtar, Jehangir\u2019s counsel, said that his client had remained the district president and asserted that party officials were not appointed according to its constitution, which was necessary.<\/p>\n<p>He said that the ECP was supposed to be provided with an updated list of office-bearers. \u201cAn electoral symbol is also given to a party according to its credibility,\u201d he said, adding that it was important to keep in mind the party\u2019s constitution and the rights of voters.<\/p>\n<p>When the hearing resumed after a short break, Akhtar continued his arguments. Justice Ali asked if the ECP had imposed a fine for holding unconstitutional intra-party polls, to which the lawyer replied that the electoral watchdog had taken action under Section 215 (eligibility of party to obtain election symbol) of the Elections Act.<\/p>\n<p>When the judge noted that the said law did not mention intra-party polls, Akhtar contended that the process \u201cautomatically came under Section 215\u201d as the intra-party elections were to be held according to the Elections Act and the party constitution.<\/p>\n<p>Upon the lawyer recalling that his client had sought the intra-party polls to be held again, Justice Anwar observed that that matter was closed as a timeframe of 20 days was given for the same.<\/p>\n<p>When Akhtar said he wanted to present arguments on \u201chow the intra-party polls were held\u201d, Justice Anwar said he could not do so as other petitioners had not been heard on that aspect.
