{"id":4357,"date":"2023-09-15T14:22:15","date_gmt":"2023-09-15T14:22:15","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/sc-orders-restoration-of-corruption-cases-against-public-office-holders\/"},"modified":"2023-09-15T14:22:15","modified_gmt":"2023-09-15T14:22:15","slug":"sc-orders-restoration-of-corruption-cases-against-public-office-holders","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/sc-orders-restoration-of-corruption-cases-against-public-office-holders\/","title":{"rendered":"SC orders restoration of corruption cases against public office holders"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>In a 2-1 verdict, the Supreme Court (SC) on Friday ordered to restore the corruption cases against public office holders that were withdrawn after amendments were made to the country\u2019s accountability laws.<\/p>\n<p>The reserved verdict was announced by a three-member bench comprising Chief Justice of Pakistan (CJP) Umar Ata Bandial, Justice Ijazul Ahsan and Justice Syed Mansoor Ali Shah on PTI Chairman Imran Khan\u2019s 2022 petition challenging amendments made to the accountability laws.<\/p>\n<p>CJP Bandial and Justice Ahsan declared Imran\u2019s plea to be maintainable while Justice Shah disagreed with the majority verdict, according to which not just the corruption cases but also the inquiries and investigations were directed to be restored.<\/p>\n<figure class=\"media  w-full  w-full  media--stretch  media--embed  \">\n<p><div class=\"ast-oembed-container \" style=\"height: 100%;\"><iframe title=\"\ud83d\udd34\ud835\udc0b\ud835\udc22\ud835\udc2f\ud835\udc1e: Supreme Court Announces Verdict On Imran Khan&#039;s Plea Challenging NAB Amendment\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/vmO-85_szM4?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/div>\n<\/p>\n<\/figure>\n<p>The court also declared some amendments to the accountability laws to be contrary to the Constitution and struck them down.<\/p>\n<p>These included one which limited the National Accountability Bureau\u2019s (NAB) jurisdiction to cases involving over Rs500 million and one which allowed the accused to claim the amount of plea bargain deposited after being acquitted.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1727654\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>The court directed that the cases that were withdrawn after NAB\u2019s jurisdiction was limited to investigating cases below Rs500m be fixed for hearing in accountability courts.<\/p>\n<p>The court also declared null and void the verdicts issued by the accountability courts in light of the amendments made to the laws.<\/p>\n<p>It directed that the cases withdrawn as a result of the amendments be fixed for hearing in accountability courts within a week. The court further directed the NAB to send the records to the relevant courts within seven days.<\/p>\n<p>In June 2022, the PTI chief had <a href=\"https:\/\/www.dawn.com\/news\/1696656\">moved<\/a> the apex court against amendments made to the National Accountability Bureau (NAB) ordinance under the National Accountability (Second Amendment) Act 2022.<\/p>\n<p>The amendments made several changes to the National Accountability Ordinance (NAO) 1999, including reducing the term of the NAB chairman and prosecutor general to three years, limiting NAB\u2019s jurisdiction to cases involving over Rs500 million, and transferring all pending inquiries, investigations, and trials to the relevant authorities.<\/p>\n<p>In his petition, the PTI chief had claimed that the amendments to the NAB law had been made to benefit influential accused persons and legitimise corruption.<\/p>\n<p>In recent hearings, Justice Shah had <a href=\"https:\/\/www.dawn.com\/news\/1772874\">repeatedly<\/a> urged for a full court to hear the case, citing the <a href=\"https:\/\/www.dawn.com\/news\/1747432\">frozen<\/a> Supreme Court (Practice and Procedure) law.<\/p>\n<p>However, CJP Bandial had opposed it, noting that his retirement was near and the matter had already been <a href=\"https:\/\/www.dawn.com\/news\/1700520\">pending<\/a> before the court for a considerable time \u2014 since at least July 19, 2022.<\/p>\n<p>The SC had <a href=\"https:\/\/www.dawn.com\/news\/1774332\">reserved its verdict<\/a> in the case on September 5, after 53 hearings, with the members of the three-judge bench debating the power of parliament to enact legislation with retrospective effect. Making a reference to the judgement, the bench had said something \u201cshort and sweet\u201d would be released soon.<\/p>\n<p>Speaking to the media outside the SC after the verdict was announced, PTI lawyer Shoaib Shaheen said that the first order of business of the previous Pakistan Democratic Movement (PDM) government was to introduce amendments to the NAB laws.<\/p>\n<p>He said that the amendments had been declared to be a violation of Articles 9 (security of person), 14 (inviolability of dignity of man, etc) and 89 (power of president to promulgate ordinances) of the Constitution.<\/p>\n<p>He further said that cases that were below Rs500m had been restored after today\u2019s verdict. He further said that the previous government had introduced several changes in order to benefit itself.<\/p>\n<p>\u201cThe amendments were prepared by the Sharif family\u2019s personal lawyers,\u201d he alleged. At the same time, Shaheen said that the NAB was still being used to target Imran.<\/p>\n<h2><a id=\"mixed-reactions-from-politicians\" href=\"#mixed-reactions-from-politicians\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>Mixed reactions from politicians<\/h2>\n<p>Former interior minister Rana Sanaullah congratulated the PTI and Imran for today\u2019s verdict, snarking that the party would now be punished by the \u201cdraconian law\u201d the same way the PML-N did.<\/p>\n<p>\u201cI was always of the opinion that the NAB law should not have been changed so that other people too could suffer the way we did. But sense prevailed and amendments were made to the law,\u201d he recalled.<\/p>\n<p>But now, the PML-N leader continued, the PTI would now have to undergo the same \u201cdifficulties that we did\u201d.<\/p>\n<p>\u201cThey won\u2019t be able to go to court and get bails in dozens anymore. This is karma \u2026 we have suffered remands and inquiries in our cases, now the tables have turned,\u201d Sanaullah added.<\/p>\n<p>PPP Chairman Bilawal Bhutto-Zardari said the decision was \u201cexpected\u201d.<\/p>\n<p>\u201cWe have an established and clear stance about NAB: it is a dictator-made institution that should cease to operate,\u201d he stated.<\/p>\n<p>Bilawal mentioned that he had not read the SC verdict but stated, \u201cIt is sufficient to say that it was expected.\u201d He went on to say that the PPP had fought NAB cases against its members before, irrespective of whether they were filed under the new law or the old law.<\/p>\n<p>Former PTI leader Fawad Chaudhry said the verdict had restored the corruption cases against the \u201cformer ruling junta\u201d. At the same time, he said that the issue had highlighted the need for a charter of democracy as \u201cno one believes [that] the NAB law needs no amendments\u201d.<\/p>\n<p>\u201cA majority do want amendments to bring fairness and transparency in NAB cases. This should include live coverage of court cases and remand provisions,\u201d he said.<\/p>\n<p>Reacting to the SC\u2019s verdict, former PPP leader Mustafa Nawaz Khokhar said that NAB was the \u201cstick used by our establishment to whack politicians in line\u201d.<\/p>\n<p>\u201cIt\u2019s ironical that the SC, which itself has decried NAB\u2019s role in victimisation and political engineering, has strengthened it once again,\u201d he said.<\/p>\n<h2><a id=\"the-petition\" href=\"#the-petition\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>The petition<\/h2>\n<p>In his petition, Imran had claimed that the amendments to the NAB law had been made to benefit the influential accused persons and legitimise corruption.<\/p>\n<p>The coalition government led by the PML-N had introduced 27 key amendments to NAO, but President Dr Arif Alvi did not accord his assent to these. However, the bill was adopted in a joint sitting of parliament and notified later.<\/p>\n<p>The petition pleaded that the fresh amendments tend to scrap corruption cases against the president, prime minister, chief ministers and ministers and provide an opportunity to the convicted public office-holders to get their convictions undone.<\/p>\n<p>\u201cThe amendments to the NAO is tantamount to depriving the citizens of Pakistan of having access to law to effectively question their chosen representatives in case of breach of their duty towards the people of Pakistan,\u201d the petition argued.<\/p>\n<p>Moreover, the word \u201cbenamidar\u201d has been re-defined, making it difficult for the prosecution to prove someone as a fictitious owner of a property, the petition argued.<\/p>\n<h2><a id=\"cjp-bandial-bids-adieu\" href=\"#cjp-bandial-bids-adieu\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>CJP Bandial bids adieu<\/h2>\n<p>Earlier in the day, CJP Bandial had greeted the lawyers and reporters in the courtroom with a final \u201cgood to see you\u201d.<\/p>\n<p>The lawyers present in the courtroom praised the apex judge\u2019s patience and expressed their well wishes for him.<\/p>\n<p>Presiding over a hearing alongside Justice Muhammad Ali Mazhar and Justice Ayesha Malik, the CJP took the chance to reflect on his tenure as top judge.<\/p>\n<p>Justice Bandial said he \u201calways worked while keeping God\u2019s pleasure in mind\u201d, adding that it was his duty to do so.<\/p>\n<p>Thanking journalists, he said he \u201cwelcomed criticism from the media\u201d.
