{"id":4281,"date":"2023-09-15T09:59:04","date_gmt":"2023-09-15T09:59:04","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/sc-orders-to-restore-graft-cases-against-public-office-holders\/"},"modified":"2023-09-15T09:59:04","modified_gmt":"2023-09-15T09:59:04","slug":"sc-orders-to-restore-graft-cases-against-public-office-holders","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/sc-orders-to-restore-graft-cases-against-public-office-holders\/","title":{"rendered":"SC orders to restore graft cases against public office holders"},"content":{"rendered":"<div>\n<p><strong>ISLAMABAD: The Supreme Court of Pakistan on Friday struck down amendments made to National Accountability Bureau (NAB) laws as it announced its reserved verdict on the Pakistan Tehreek-e-Insaf (PTI) chairman\u2019s plea, <\/strong><strong>ARY News reported.<\/strong><\/p>\n<p>In a majority 2-1 verdict, the top court approved Pakistan Tehreek-e-Insaf (PTI) chief Imran Khan\u2019s petition challenging amendments made to the country\u2019s accountability laws during the tenure of the previous Pakistan Democratic Movement (PDM)-led government.<\/p>\n<p>The three-member bench, headed by CJP Umar Ata Bandial, and comprising Justice Mansoor Ali Shah and Justice Ijazul Ahsan reserved the judgment on the hearing on September 5.<\/p>\n<p><div class=\"ast-oembed-container \" style=\"height: 100%;\"><iframe title=\"\ud83d\udd34LIVE | NAB Amendments Case verdict | Supreme Court historical decision | ARY News Live\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/HlPM2k06FVY?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/div>\n<\/p>\n<p><a href=\"https:\/\/www.youtube.com\/@ArynewsTvofficial\">CJP Bandial<\/a> and Justice Ahsan declared Imran\u2019s plea to be maintainable while Justice Shah disagreed with the verdict.<\/p>\n<p>The top court also restored graft cases against public office holders that were closed down following the amendments to NAB laws.<\/p>\n<p>Following the verdict, the references against some of the country\u2019s political bigwigs will once again land in the accountability courts.<\/p>\n<p>These include the Toshakhana reference against Pakistan Muslim League-Nawaz (PML-N) Supremo Nawaz Sharif, Pakistan Peoples Party Co-Chairman Asif Ali Zardari and former prime minister Yousuf Raza Gilani, LNG reference against former prime minister Shahid Khaqan Abbasi, rental power reference against former prime minister Raja Pervez Ashraf and assets beyond means case against former finance minister Ishaq Dar.<\/p>\n<p>In June 2022, the former premier had moved the apex court against amendments made to the National Accountability Bureau (NAB) ordinance under the National Accountability (Second Amendment) Act 2022.<\/p>\n<h5><strong>NAB law amendment<\/strong><\/h5>\n<p>The NAB (Second Amendment) Bill 2021 states that NAB\u2019s deputy chairman, to be appointed by the federal government, would become the acting chairman of the bureau following the completion of the tenure of the chairman.<\/p>\n<p>The bill has also reduced the four-year term of the NAB chairman. After approval of the law, NAB will not be able to act on federal, provincial or local tax matters.<\/p>\n<p>It has also set a three-year term for the judges of the accountability courts.
