{"id":4271,"date":"2023-09-15T08:18:06","date_gmt":"2023-09-15T08:18:06","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/sc-orders-to-restore-corruption-cases-against-public-office-holders\/"},"modified":"2023-09-15T08:18:06","modified_gmt":"2023-09-15T08:18:06","slug":"sc-orders-to-restore-corruption-cases-against-public-office-holders","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/sc-orders-to-restore-corruption-cases-against-public-office-holders\/","title":{"rendered":"SC orders to restore corruption cases against public office holders"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>In a 2-1 majority verdict, the Supreme Court (SC) on Friday ordered to restore the corruption cases against public office holders that were withdrawn after amendments were made to the country\u2019s accountability laws.<\/p>\n<p>The reserved verdict was announced by a three-member bench comprising Chief Justice of Pakistan (CJP) Umar Ata Bandial, Justice Ijazul Ahsan and Justice Syed Mansoor Ali Shah on PTI Chairman Imran Khan\u2019s 2022 petition challenging amendments made to the accountability laws.<\/p>\n<p>CJP Bandial and Justice Ahsan declared Imran\u2019s plea to be maintainable while Justice Shah disagreed with the majority verdict.<\/p>\n<figure class=\"media  w-full  w-full  media--stretch  media--embed  \">\n<p><div class=\"ast-oembed-container \" style=\"height: 100%;\"><iframe title=\"\ud83d\udd34\ud835\udc0b\ud835\udc22\ud835\udc2f\ud835\udc1e: Supreme Court Announces Verdict On Imran Khan&#039;s Plea Challenging NAB Amendment\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/vmO-85_szM4?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/div>\n<\/p>\n<\/figure>\n<p>In June 2022, the former premier had <a href=\"https:\/\/www.dawn.com\/news\/1696656\">moved<\/a> the apex court against amendments made to the National Accountability Bureau (NAB) ordinance under the National Accountability (Second Amendment) Act 2022.<\/p>\n<p>The amendments made several changes to the National Accountability Ordinance (NAO) 1999, including reducing the term of the NAB chairman and prosecutor general to three years, limiting NAB\u2019s jurisdiction to cases involving over Rs500 million, and transferring all pending inquiries, investigations, and trials to the relevant authorities.<\/p>\n<p>In his petition, the PTI chief had claimed that the amendments to the NAB law had been made to benefit influential accused persons and legitimise corruption.<\/p>\n<p>In recent hearings, Justice Shah had <a href=\"https:\/\/www.dawn.com\/news\/1772874\">repeatedly<\/a> urged for a full court to hear the case, citing the <a href=\"https:\/\/www.dawn.com\/news\/1747432\">frozen<\/a> Supreme Court (Practice and Procedure) law.<\/p>\n<p>However, CJP Bandial had opposed it, noting that his retirement was near and the matter had already been <a href=\"https:\/\/www.dawn.com\/news\/1700520\">pending<\/a> before the court for a considerable time \u2014 since at least July 19, 2022.<\/p>\n<p>The SC had <a href=\"https:\/\/www.dawn.com\/news\/1774332\">reserved its verdict<\/a> in the case on September 5, after 53 hearings, with the members of the three-judge bench debating the power of parliament to enact legislation with retrospective effect. Making a reference to the judgement, the bench had said something \u201cshort and sweet\u201d would be released soon.<\/p>\n<h2><a id=\"the-petition\" href=\"#the-petition\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>The petition<\/h2>\n<p>In his petition, Imran had claimed that the amendments to the NAB law had been made to benefit the influential accused persons and legitimise corruption.<\/p>\n<p>The coalition government led by the PML-N had introduced 27 key amendments to NAO, but President Dr Arif Alvi did not accord his assent to these. However, the bill was adopted in a joint sitting of parliament and notified later.<\/p>\n<p>The petition pleaded that the fresh amendments tend to scrap corruption cases against the president, prime minister, chief ministers and ministers and provide an opportunity to the convicted public office-holders to get their convictions undone.<\/p>\n<p>\u201cThe amendments to the NAO is tantamount to depriving the citizens of Pakistan of having access to law to effectively question their chosen representatives in case of breach of their duty towards the people of Pakistan,\u201d the petition argued.<\/p>\n<p>Moreover, the word \u201cbenamidar\u201d has been re-defined, making it difficult for the prosecution to prove someone as a fictitious owner of a property, the petition argued.<\/p>\n<hr\/>\n<p><em>More to follow<\/em><\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>In a 2-1 majority verdict, the Supreme Court (SC) on Friday ordered to restore the corruption cases against public office holders that were withdrawn after amendments were made to the country\u2019s accountability laws.
