{"id":42681,"date":"2024-01-01T21:53:05","date_gmt":"2024-01-01T21:53:05","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/ecps-acceptance-of-nawazs-nomination-papers-from-lahores-na-130-challenged\/"},"modified":"2024-01-01T21:53:05","modified_gmt":"2024-01-01T21:53:05","slug":"ecps-acceptance-of-nawazs-nomination-papers-from-lahores-na-130-challenged","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/ecps-acceptance-of-nawazs-nomination-papers-from-lahores-na-130-challenged\/","title":{"rendered":"ECP\u2019s acceptance of Nawaz\u2019s nomination papers from Lahore\u2019s NA-130 challenged"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>The acceptance of PML-N supremo Nawaz Sharif\u2019s nomination papers from Lahore\u2019s constituency NA-130 for the upcoming Feb 8 general elections was challenged on Monday.<\/p>\n<p>Last week, the Election Commission of Pakistan (ECP) had <a href=\"https:\/\/www.dawn.com\/news\/1801985\">approved<\/a> the candidature of the former premier while rejecting the same of PTI bigwigs, including Imran Khan and Shah Mahmood Qureshi.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1802223\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>Today, Advocate Ishtiaq Ahmed Samsialvi, who also goes by Ishtiaq Chaudhry, the chief organiser of <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/www.facebook.com\/pakistanawamimahaz?_rdc=1&amp;_rdr\">Pakistan Awami Mahaz<\/a>\u2018s (PAM) lawyers\u2019 wing, filed an appeal before the Lahore High Court\u2019s appellate tribunal under Section 63 (appeal against scrutiny order) of the <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/na.gov.pk\/uploads\/documents\/1506961151_781.pdf\">Elections Act 2017<\/a>.<\/p>\n<p>Chaudhry, also a candidate for NA-130, challenged the rejection of his nomination papers as well. The constituency\u2019s returning officer (RO), the ECP and Nawaz have been made respondents in the case.<\/p>\n<p>In his petition, the PAM leader urged the tribunal to strike down the acceptance of Nawaz\u2019s papers as \u201cillegal and unlawful\u201d and that the papers be rejected due to his <a href=\"https:\/\/www.dawn.com\/news\/1348191\">2017 disqualification<\/a> in the Panama Papers case, which the Supreme Court <a href=\"https:\/\/www.dawn.com\/news\/1401362\">ruled<\/a> was for life.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1802318\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>The appeal, seen by <em>Dawn.com<\/em>, also requested that he be allowed to contest the upcoming polls.<\/p>\n<p>The SC advocate asked whether the apex court\u2019s judgment was \u201cnot binding upon all the institutions\u201d, including the ECP. The appellant further wondered whether he could be \u201crestricted from contesting election in absence of any adverse order passed\u201d by the RO.<\/p>\n<p>Chaudhry stated that he filed his nomination papers on Dec 23 and that the RO accepted them \u201cwithout any objection\u201d upon scrutiny a few days later. He was told his name would be included in the list of eligible candidates issued on Dec 30, he added.<\/p>\n<p>The PAM leader claimed that when he asked for copies of Nawaz\u2019s nomination papers so he could file objections against them, the RO refused to provide them.<\/p>\n<p>He argued that his name has been excluded from the list \u201cillegally and unlawfully in absence of any order\u201d and that the former prime minister\u2019s <a href=\"https:\/\/www.dawn.com\/news\/1401362\">lifetime disqualification<\/a> \u201cstill holds the field\u201d under Article 62 (1)(f) (qualifications for membership of parliament) of the Constitution.<\/p>\n<p>Asserting that the RO \u201cignored\u201d deciding the objection raised by him, Chaudhry said \u201cno rule or law can override the judgment of the Supreme Court, which is the final arbitrator to decide all matters in all respects\u201d.<\/p>\n<p>He contended that the RO had \u201cno justification\u201d to accept Nawaz\u2019s papers and that he was \u201cliable to be proceeded under Article 204\u201d (contempt of court) of the Constitution.<\/p>\n<p>The appeal is set to be heard tomorrow.<\/p>\n<p>According to <em><a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/www.radio.gov.pk\/01-01-2024\/ecp-to-continue-receiving-appeals-against-decisions-on-nomination-papers\">Radio Pakistan<\/a><\/em>, appeals against the acceptance or rejection of nomination papers for the polls can be submitted by Jan 3 (Wednesday) and decisions on these appeals will be made by Jan 10.<\/p>\n<p>The preliminary list of candidates will be displayed on Jan 11 and candidates can withdraw their nomination papers by the next day, it added.<\/p>\n<p>The report further stated that electoral symbols will be allotted on Jan 13 while polling for the general elections will be held on Feb 8.<\/p>\n<p>Meanwhile, according to the revised schedule for reserved seats of women and non-Muslims, the last date for the scrutiny of the nomination papers is Jan 13 while the last date for filing appeals against decisions of ROs is Jan 16.<\/p>\n<p>The revised list of candidates for reserved seats will be published on the 20th and candidates can withdraw their papers by Jan 22.
