{"id":34108,"date":"2023-12-11T08:36:30","date_gmt":"2023-12-11T08:36:30","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/indias-top-court-upholds-end-of-special-status-for-held-kashmir-orders-polls\/"},"modified":"2023-12-11T08:36:30","modified_gmt":"2023-12-11T08:36:30","slug":"indias-top-court-upholds-end-of-special-status-for-held-kashmir-orders-polls","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/indias-top-court-upholds-end-of-special-status-for-held-kashmir-orders-polls\/","title":{"rendered":"India\u2019s top court upholds end of special status for held Kashmir, orders polls"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>India\u2019s Supreme Court on Monday ruled in a unanimous verdict that the special status of held Kashmir was a temporary provision and upheld the order <a href=\"https:\/\/www.dawn.com\/news\/1498227\">abrogating Article 370<\/a> in the constitution, the <em>Times of India<\/em> <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/timesofindia.indiatimes.com\/india\/article-370-news-live-updates-supreme-court-verdict-on-abrogation-of-article-370-jammu-and-kashmir-special-status\/liveblog\/105887341.cms\">reported<\/a>.<\/p>\n<p>It also directed the election commission to hold elections in held Kashmir by September 30, 2024.<\/p>\n<p>In 2019, India\u2019s ruling Bharatiya Janata Party (BJP) had <a href=\"https:\/\/www.dawn.com\/news\/1498227\">revoked<\/a> occupied Kashmir\u2019s special status by repealing Article 370 of the constitution. The law had limited the power of the Indian parliament to impose laws in the state, apart from matters of defence, foreign affairs and communications.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1763985\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>The move allowed people from the rest of the country to have the right to acquire property in held Kashmir and settle there permanently.<\/p>\n<p>Kashmiris, international organisations and critics of India\u2019s Hindu nationalist-led government had termed the move an attempt to dilute the demographics of Muslim-majority Kashmir with Hindu settlers.<\/p>\n<p>A five-member bench headed by Chief Justice of India (CJI) D.Y. Chandrachud had <a href=\"https:\/\/www.dawn.com\/news\/1764130\">begun hearing<\/a> the set of petitions challenging the reading down of Article 370 of the Indian constitution on on July 11 and <a href=\"https:\/\/www.dawn.com\/news\/1774200\">reserved its verdict<\/a> on September 5.<\/p>\n<p>The move was challenged by the region\u2019s pro-India political parties, the local Bar Association and individual litigants. The pleas, including those filed by the National Conference and the People\u2019s Democratic Party, had also challenged India-held Kashmir\u2019s bifurcation into two union territories.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1768095\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>Today, CJI read out the operative part of the verdict written by him for himself and Justices B R Gavai and Surya Kant, <em>TOI<\/em> reported. Justices Sanjay Kishan Kaul and Sanjiv Khanna wrote separate but concurrent judgments.<\/p>\n<p>CJI Chandrachud observed the petitioners\u2019 contention that the centre could not take any decision during proclamation under Article 356 was not acceptable, <em>TOI<\/em> said.<\/p>\n<p>\u201cArticle 370 of the Constitution was an interim arrangement due to war conditions in state. Constituent assembly of Jammu and Kashmir was never intended to be permanent body,\u201d CJI Chandrachud was quoted as saying.<\/p>\n<p>The 2019 declaration was \u201ca culmination of the process of integration and as such is a valid exercise of power\u201d, the court said in its verdict.<\/p>\n<p>The Indian apex court said occupied Kashmir did not retain the element of sovereignty after joining India. It further said it did not need to adjudicate on the validity of the presidential proclamation in the region as the petitioners had not challenged it.<\/p>\n<p>According to the report, the ruling also termed petitioners\u2019 arguments that the union government cannot take actions of irreversible consequences in the state during presidential rule as unacceptable.<\/p>\n<p>Noting that Article 370 was a temporary provision, the SC said India-held Kashmir became an \u201cintegral part\u201d of the country as reflected in Articles 1 and 370 of its constitution.<\/p>\n<p>The CJI observed that Article 370 was meant for constitutional integration of the region with the union and not for disintegration, and that the President can declare that the said article ceases to exist.<\/p>\n<p>The SC also upheld the reorganisation of Ladakh as a union territory.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1498232\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>The apex court also directed the country\u2019s election commission to take steps to conduct elections for legislative assembly, <em>TOI<\/em> stated.<\/p>\n<p>It ordered that India-held Kashmir be restored to the same statehood as any other Indian state \u2014 with no separate autonomy rights \u2014 \u201cat the earliest and as soon as possible\u201d.<\/p>\n<p>Remarking that the people of occupied Kashmir \u201cwent through a lot and wounds need healing\u201d, Justice Kaul directed that a truth and reconciliation commission be set up to probe human rights violations by state and non-state actors since the 1980s, the report said.<\/p>\n<p>Reacting to the order, Indian Prime Minister Narendra Modi termed the verdict a \u201cbeacon of hope\u201d and said it \u201cconstitutionally upholds the decision taken by the Parliament of India on Aug 5, 2019\u201d.<\/p>\n<p>Meanwhile, senior Congress leader Karan Singh said a section of the people in occupied Kashmir \u201cwill not be happy with this judgment\u201d.<\/p>\n<p>Former prime minister Shehbaz Sharif said the Indian SC had \u201cviolated the international laws by giving a decision against the resolutions of the United Nations\u201d.<\/p>\n<p>Stating that the court has \u201cbetrayed the sacrifice of millions of Kashmiris\u201d, Shehbaz asserted the verdict will be seen as a \u201crecognition of the murder of justice\u201d.<\/p>\n<p>Ahead of the verdict\u2019s announcement, Mehbooba Mufti and Omar Abdullah, the president of the PDP and the National Conference \u2014 petitioners in the case \u2014 were put under house arrest, <em>TOI<\/em> <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/timesofindia.indiatimes.com\/india\/article-370-verdict-jk-special-status-sc-ruling-abrogation-of-article-370-latest-developments\/articleshow\/105893282.cms\">reported<\/a>.<\/p>\n<hr\/>\n<p><em>Additional input from AFP<\/em>.<\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>India\u2019s Supreme Court on Monday ruled in a unanimous verdict that the special status of held Kashmir was a temporary provision and upheld the order abrogating Article 370 in the constitution, the Times of India reported.
