{"id":33316,"date":"2023-12-09T09:00:56","date_gmt":"2023-12-09T09:00:56","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/may-9-riots-sc-to-hear-intra-court-appeals-against-verdict-nullifying-military-trials-of-civilians-on-dec-13\/"},"modified":"2023-12-09T09:00:56","modified_gmt":"2023-12-09T09:00:56","slug":"may-9-riots-sc-to-hear-intra-court-appeals-against-verdict-nullifying-military-trials-of-civilians-on-dec-13","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/may-9-riots-sc-to-hear-intra-court-appeals-against-verdict-nullifying-military-trials-of-civilians-on-dec-13\/","title":{"rendered":"May 9 riots: SC to hear intra-court appeals against verdict nullifying military trials of civilians on Dec 13"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>A six-member Supreme Court bench will hear a set of intra-court appeals (ICAs) challenging its <a href=\"https:\/\/www.dawn.com\/news\/1783065\">Oct 23 unanimous verdict<\/a>, wherein it had nullified military trials of 103 civilians, on Dec 15 (Wednesday).<\/p>\n<p>In the <a href=\"https:\/\/www.dawn.com\/news\/1783105\">widely praised<\/a> ruling, a five-member SC bench \u2014 comprising Justices Ijazul Ahsan, Munib Akhtar, Yahya Afridi, Syed Mazahar Ali Akbar Naqvi and Ayesha Malik \u2014 had declared that trying <a href=\"https:\/\/www.dawn.com\/news\/1792369\">103 civilians<\/a> in military courts for their alleged role in attacks on army installations during the <a href=\"https:\/\/www.dawn.com\/news\/1751955\">riots<\/a> that followed ex-premier <a href=\"https:\/\/www.dawn.com\/news\/1751782\">Imran Khan\u2019s arrest<\/a> on May 9 was ultra vires the Constitution.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1753472\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>The apex court had declared that the accused would not be tried in military courts but in criminal courts of competent jurisdiction established under the ordinary or special law of the land.<\/p>\n<p>The appeals have been filed by the <a href=\"https:\/\/www.dawn.com\/news\/1790132\">caretaker federal government<\/a> as well as the provincial ones in <a href=\"https:\/\/www.dawn.com\/news\/1790251\">Balochistan<\/a>, <a href=\"https:\/\/www.dawn.com\/news\/1792369#:~:text=defence%20ministry%2C%20the-,Khyber,-Pakhtunkhwa%20and%20Balochistan\">Khyber Pakhtunkhwa<\/a> and <a href=\"https:\/\/www.dawn.com\/news\/1791246\">Punjab<\/a>. Meanwhile, Sindh has <a href=\"https:\/\/www.dawn.com\/news\/1790618\">denied<\/a> filing a <a href=\"https:\/\/www.dawn.com\/news\/1790032\">purported plea<\/a> on the same matter.<\/p>\n<p>The <a href=\"https:\/\/www.dawn.com\/news\/1791115\">defence ministry<\/a> has also moved an ICA before the SC against its judgement, requesting the apex court to suspend the verdict\u2019s operation during the pendency of the appeal.<\/p>\n<p>In addition to the ICAs, a contempt of court petition had also been <a href=\"https:\/\/www.dawn.com\/news\/1794975\">filed<\/a> before the Supreme Court against Defence Secretary retired Lt Gen Hamooduz Zaman Khan for allegedly disregarding its Oct 23 verdict.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1790837\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>According to a cause list released today, a six-member larger bench headed by Justice Sardar Tariq Masood will take up the ICAs at 11:30am on Dec 13 (Wednesday).<\/p>\n<p>The bench includes Justice Aminuddin Khan, Justice Muhammad Ali Mazhar, Justice Syed Hasan Azhar Rizvi, Justice Musarrat Hilali and Justice Irfan Saadat Khan.<\/p>\n<h2><a id=\"the-appeals\" href=\"#the-appeals\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>The appeals<\/h2>\n<p>The ICAs claim that through the order, the SC had traversed beyond its jurisdiction and excluded from the ambit of the <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/pakistancode.gov.pk\/pdffiles\/administrator5a436c410d7fc88fc27dae7b864c6f63.pdf\">Pakistan Army Act (PAA) 1952<\/a>, civilians who may be guilty of committing offences specified in Section 2 (d)(1) of the PAA, thereby considerably undermining the ability of armed forces to discharge their constitutional duty to defend Pakistan against external aggression or threat of war and thus violating the very letter and purport of Article 245 (1) (functions of armed forces) of the Constitution.<\/p>\n<p>The appeals questioned whether seducing or attempting to seduce any person who was subject to PAA from his duty or allegiance to government, or commission of any offence under the <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/pakistancode.gov.pk\/pdffiles\/administrator46c9a3c62acc16428e73999e7d30ba2a.pdf\">Official Secrets Act 1923<\/a> \u2014 in relation to any work of defence, arsenal, military establishment or station or military affairs of Pakistan \u2014 by civilians were not acts having direct nexus with armed forces.<\/p>\n<p>Thus the civilians accused of these offences are legally triable under PAA as held in and on the touchstone of the principle laid down in a previous case of retired Brig F.B.
