{"id":32898,"date":"2023-12-08T08:53:04","date_gmt":"2023-12-08T08:53:04","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/indian-sc-to-announce-verdict-on-removal-of-occupied-kashmirs-special-status-on-dec-11\/"},"modified":"2023-12-08T08:53:04","modified_gmt":"2023-12-08T08:53:04","slug":"indian-sc-to-announce-verdict-on-removal-of-occupied-kashmirs-special-status-on-dec-11","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/indian-sc-to-announce-verdict-on-removal-of-occupied-kashmirs-special-status-on-dec-11\/","title":{"rendered":"Indian SC to announce verdict on removal of occupied Kashmir\u2019s special status on Dec 11"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>India\u2019s Supreme Court will pronounce its verdict on a set of pleas against New Delhi\u2019s 2019 imposition of direct rule in occupied Kashmir on Dec 11 (Monday), <em>The Times of India<\/em> <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/timesofindia.indiatimes.com\/city\/delhi\/supreme-court-verdict-on-article-370-monday\/articleshow\/105825048.cms\">reported<\/a> on Friday.<\/p>\n<p>In 2019, India\u2019s ruling Bharatiya Janata Party (BJP) had revoked occupied Kashmir\u2019s special status by <a href=\"https:\/\/www.dawn.com\/news\/1498227\">repealing Article 370<\/a> of the constitution.<\/p>\n<p>Article 370 had limited the power of the Indian parliament to impose laws in the state, apart from matters of defence, foreign affairs and communications.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1763985\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>The move allowed people from the rest of the country to have the right to acquire property in occupied Kashmir and settle there permanently.<\/p>\n<p>Kashmiris, international organisations and critics of India\u2019s Hindu nationalist-led government had termed the move an attempt to dilute the demographics of Muslim-majority Kashmir with Hindu settlers.<\/p>\n<p>A five-member bench headed by Chief Justice of India (CJI) D.Y. Chandrachud had <a href=\"https:\/\/www.dawn.com\/news\/1764130\">begun hearing<\/a> the set of petitions on July 11 and <a href=\"https:\/\/www.dawn.com\/news\/1774200\">reserved<\/a> its verdict on September 5.<\/p>\n<p>According to <em><a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/www.indiatoday.in\/law\/story\/supreme-court-to-deliver-verdict-on-abrogation-of-article-370-on-december-11-2473358-2023-12-07\">India Today<\/a><\/em>, the petitioners included leaders of the National Conference and the People\u2019s Democratic Party (PDP).<\/p>\n<p>The bench \u2014 also including Justices Sanjay Kishan Kaul, Sanjiv Khanna, B. R. Gavai and Surya Kant \u2014 is to decide if the move was legal despite lacking the endorsement from parliament usually required for constitutional change.<\/p>\n<p>During the proceedings, the PDP had told the court that then-governor Satya Pal Malik was not consulted before the decision was taken by the central government to abrogate Article 370, <em>India Today<\/em> stated.<\/p>\n<p>Meanwhile, the centre had argued in support of its step and claimed there was no \u201cconstitutional fraud\u201d in annulling the provision, the report added.<\/p>\n<p>Senior counsel Kapil Sibal had <a href=\"https:\/\/www.dawn.com\/news\/1768095\">contended<\/a> that the concurrence of the state government provided by the governor did not express the will of the people.<\/p>\n<p>The apex court had <a href=\"https:\/\/www.dawn.com\/news\/1773018\">asked<\/a> the BJP-ruled central government whether there was a timeline to convert Indian-held Kashmir from a union territory to a state.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1498232\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>Pakistan and India have fought three wars over control of the region and thousands have been killed in a freedom movement against Indian rule in the Muslim-majority territory since 1989.<\/p>\n<p>The suspension of occupied Kashmir\u2019s semi-autonomous status allowed Indians from elsewhere to buy land and claim government jobs there, a policy denounced by critics as \u201csettler colonialism\u201d.<\/p>\n<p>Many residents and critics say that authorities have since curbed media freedoms and public protests in a drastic curtailment of civil liberties.<\/p>\n<p>Indian Prime Minister Narendra Modi\u2019s government has defended the decision in the court, saying the change had brought \u201cpeace, progress and prosperity\u201d to the restive territory.<\/p>\n<p>Consolidating New Delhi\u2019s rule over its portion of the territory has long been a key plank of Modi\u2019s Hindu nationalist BJP.<\/p>\n<p>The frequency of armed clashes between Indian soldiers and freedom fighters has dropped significantly in recent years as India works to fortify its rule over the territory.<\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>India\u2019s Supreme Court will pronounce its verdict on a set of pleas against New Delhi\u2019s 2019 imposition of direct rule in occupied Kashmir on Dec 11 (Monday), The Times of India reported on Friday.
