{"id":31372,"date":"2023-12-04T10:29:07","date_gmt":"2023-12-04T10:29:07","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/may-9-riots-sc-urged-to-initiate-contempt-proceedings-against-defence-secretary-for-violating-order-on-civilians-military-trials\/"},"modified":"2023-12-04T10:29:07","modified_gmt":"2023-12-04T10:29:07","slug":"may-9-riots-sc-urged-to-initiate-contempt-proceedings-against-defence-secretary-for-violating-order-on-civilians-military-trials","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/may-9-riots-sc-urged-to-initiate-contempt-proceedings-against-defence-secretary-for-violating-order-on-civilians-military-trials\/","title":{"rendered":"May 9 riots: SC urged to initiate contempt proceedings against defence secretary for \u2018violating\u2019 order on civilians\u2019 military trials"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>The Supreme Court on Monday was urged to initiate contempt proceedings against the defence secretary for \u201cviolating\u201d its <a href=\"https:\/\/www.dawn.com\/news\/1783065\">Oct 23 verdict<\/a>, wherein it had nullified military trials of civilians.<\/p>\n<p>In the <a href=\"https:\/\/www.dawn.com\/news\/1783105\">widely praised<\/a> Oct 23 ruling, a five-member SC bench \u2014 comprising Justices Ijazul Ahsan, Munib Akhtar, Yahya Afridi, Syed Mazahar Ali Akbar Naqvi and Ayesha Malik \u2014 had declared that trying <a href=\"https:\/\/www.dawn.com\/news\/1792369\">103 civilians<\/a> in military courts for their alleged role in attacks on army installations during the <a href=\"https:\/\/www.dawn.com\/news\/1751955\">riots<\/a> that followed ex-premier <a href=\"https:\/\/www.dawn.com\/news\/1751782\">Imran Khan\u2019s arrest<\/a> on May 9 were ultra vires the Constitution.<\/p>\n<p>The bench had also emphasised that the cases of the suspects involved in the vandalism would proceed before criminal courts.<\/p>\n<p>The <a href=\"https:\/\/www.dawn.com\/news\/1790132\">caretaker federal government<\/a> as well as the provincial ones in <a href=\"https:\/\/www.dawn.com\/news\/1790251\">Balochistan<\/a>, <a href=\"https:\/\/www.dawn.com\/news\/1792369#:~:text=defence%20ministry%2C%20the-,Khyber,-Pakhtunkhwa%20and%20Balochistan\">Khyber Pakhtunkhwa<\/a> and <a href=\"https:\/\/www.dawn.com\/news\/1791246\">Punjab<\/a> have filed appeals in the apex court, challenging its Oct 23 verdict. Meanwhile, Sindh has <a href=\"https:\/\/www.dawn.com\/news\/1790618\">denied<\/a> filing a purported plea on the same matter.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1790837\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>The defence ministry has also moved an <a href=\"https:\/\/www.dawn.com\/news\/1791115\">intra-court appeal<\/a> (ICA) before the SC against its judgement, requesting the apex court to suspend the verdict\u2019s operation during the pendency of the ICA.<\/p>\n<p>Today, a constitutional petition was filed by members of civil society \u2014 former Karachi Metropolitan Corporation administrator Fahim Zaman Khan, Aurat Foundation Director Mahnaz Rahman, educationist Prof Dr A.H. Nayyar, and clinical psychologist and educationist Syed Zulfiqar Hussain Gilani.<\/p>\n<p>The above citizens were also petitioners in one of the <a href=\"https:\/\/www.dawn.com\/news\/1759129\">pleas<\/a> challenging the trials of civilians in military courts.<\/p>\n<p>The plea \u2014 filed under Article 204 (contempt of court) of the Constitution through Advocate Faisal Siddiqi \u2014 made Defence Secretary Lieutenant General (rtd) Hamooduz Zaman Khan a party in the case.<\/p>\n<p>It urged the court to initiate proceedings of contempt of court against retired Gen Hamooduz Zaman Khan for \u201cdeliberately and malafidely, disregarding and violating\u201d the SC\u2019s Oct 23 order.<\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court on Monday was urged to initiate contempt proceedings against the defence secretary for \u201cviolating\u201d its Oct 23 verdict, wherein it had nullified military trials of civilians.
