{"id":29405,"date":"2023-11-28T21:33:04","date_gmt":"2023-11-28T21:33:04","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/scs-justice-minallah-calls-for-trial-of-judges-who-granted-legal-cover-to-musharrafs-martial-law\/"},"modified":"2023-11-28T21:33:04","modified_gmt":"2023-11-28T21:33:04","slug":"scs-justice-minallah-calls-for-trial-of-judges-who-granted-legal-cover-to-musharrafs-martial-law","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/scs-justice-minallah-calls-for-trial-of-judges-who-granted-legal-cover-to-musharrafs-martial-law\/","title":{"rendered":"SC\u2019s Justice Minallah calls for trial of judges who granted legal cover to Musharraf\u2019s martial law"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>Supreme Court Justice Athar Minallah on Tuesday remarked that the judges who granted legal cover to late military dictator Gen Pervez Musharraf\u2019s martial law should be tried in court.<\/p>\n<p>The comments came amid the apex court\u2019s hearing on a set of appeals against the January 13, 2020, Lahore High Court <a href=\"https:\/\/www.dawn.com\/news\/1528187\">order of declaring unconstitutional<\/a> the December 17, 2019 <a href=\"https:\/\/www.dawn.com\/news\/1522774\">death sentence<\/a> awarded to Musharraf by the Special Court in the high treason case.<\/p>\n<p>Chief Justice of Pakistan (CJP) Qazi Faez Isa, Justice Syed Mansoor Ali Shah and Justice Aminuddin Khan are other members of the SC bench. Musharraf was one of the petitioners challenging the Special Court ruling.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1517639\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>In an infamous purge on November 3, 2007, Musharraf had imposed a state of emergency and placed several key judges under house arrest in Islamabad and elsewhere in Pakistan. Previously on October 12, 1999, he had staged a military coup against the PML-N government led by Nawaz Sharif.<\/p>\n<p>During today\u2019s hearing, as Sindh High Court Bar lawyer Rashid A. Rizvi mentioned Musharraf\u2019s martial law, Justice Minallah suggested he refrain from delving into the past.<\/p>\n<p>At this, the chief justice remarked that he respected his fellow judge but \u201cwe should look at the past now.\u201d<\/p>\n<p>Justice Minallah agreed with the chief justice and  pointed out that when \u201cMusharraf violated the Constitution on Oct 12, dissolved assemblies, this very court granted cover to the measures\u201d, suggesting that \u201cthere should be a trial of those judges who declared Musharraf\u2019s martial law legal.\u201d<\/p>\n<p>He questioned why legal proceedings were initiated only on the emergency imposed on Nov 3, 2007 when Supreme Court judges were arrested by the military.<\/p>\n<figure class=\"media  w-full  w-full  media--stretch  media--embed  \">\n<p><div class=\"ast-oembed-container \" style=\"height: 100%;\"><iframe title=\"Justice Athar Minallah Ka Mashwara | Breaking News | Dawn News\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/wZ_WMdqckAk?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/div>\n<\/p>\n<\/figure>\n<p>\u201cIf action will be taken only on the attack on judges on Nov 3, then the question of fair trial will be raised. Was the attack on the judges a more serious matter than dissolving the assemblies and suspending the Constitution?\u201d<\/p>\n<p>Justice Minallah told Rizvi it was \u201ctime for truth to be told\u201d.<\/p>\n<p>\u201cIf a decision has to be overturned, it should be the one that gave way to martial law. These judges should also be held accountable,\u201d the judge remarked.<\/p>\n<p>At this, CJP Isa said that he could not undo what had happened in the past.<\/p>\n<p>\u201cWas everyone punished in South Africa? If we want to become a nation, we have to fix the future by looking at the past,\u201d the chief justice observed.<\/p>\n<p>He added that at times even murderers end up evading their punishment as well and that the process of justice and accountability would take place in the afterlife as well.<\/p>\n<p>CJP Isa called on lawyers to come and explain why \u201cpictures of judges who violated the Constitution\u201d were present in the apex court, asking why should judges be the only ones to point it out.<\/p>\n<p>\u201cThe media is also responsible. It should also be held accountable. Tell me how many journalists were against and how many were in support of martial law?
