{"id":27574,"date":"2023-11-23T11:52:44","date_gmt":"2023-11-23T11:52:44","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/ecp-orders-pti-to-hold-intra-party-polls-within-20-days-or-lose-bat-as-electoral-symbol\/"},"modified":"2023-11-23T11:52:44","modified_gmt":"2023-11-23T11:52:44","slug":"ecp-orders-pti-to-hold-intra-party-polls-within-20-days-or-lose-bat-as-electoral-symbol","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/ecp-orders-pti-to-hold-intra-party-polls-within-20-days-or-lose-bat-as-electoral-symbol\/","title":{"rendered":"ECP orders PTI to hold intra-party polls within 20 days or lose bat as electoral symbol"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>The Election Commission of Pakistan (ECP) on Thursday ordered the PTI to hold intra-party elections within 20 days to retain bat as its poll symbol.<\/p>\n<p>In August, the commission had given a <a href=\"https:\/\/www.dawn.com\/news\/1768094\">final warning<\/a> to the PTI to hold the polls or it could be declared ineligible to obtain an election symbol.<\/p>\n<p>It had stated that the elections were due on June 13, 2021 under the party\u2019s constitution but a year\u2019s <a href=\"https:\/\/www.dawn.com\/news\/1768094#:~:text=the%20PTI%20and-,extension,-of%20one%20year\">extension<\/a> had been granted.<\/p>\n<p>Barrister Gohar Ali Khan, representing the PTI, had said the party elections were held before an amendment in its constitution. However, the CEC claimed that the PTI amended its constitution on June 8, 2022 and conducted intra-party polls on June 10, 2022. Khan had also said the amendment in the party constitution was later withdrawn.<\/p>\n<p>The polls organising authority had <a href=\"https:\/\/www.dawn.com\/news\/1768402#:~:text=organising%20authority%20also-,said,-it%20issued%20a\">said<\/a> it issued a final notice to the PTI in May 2022 to ensure the conduct of intra-party elections \u201con or before June 13, 2022 (extended date), with the observation that no further extension shall be allowed\u201d.<\/p>\n<p>Subsequently, the PTI submitted a copy of the amended party\u2019s constitution that was deemed \u201cinsufficient\u201d by the electoral body.<\/p>\n<p>In October, the ECP had <a href=\"https:\/\/www.dawn.com\/news\/1780451#:~:text=the%20ECP%20also-,reserved,-judgement%20on%20the\">reserved<\/a> its verdict on the maintainability of a petition by the Istehkam-i-Pakistan Party seeking to take away PTI\u2019s \u2018bat\u2019 electoral symbol.<\/p>\n<figure class=\"media  sm:w-1\/2  w-full  media--right  media--embed  media--uneven\">\n<p>    <iframe class=\"nk-iframe\" onload=\"setInterval(()=&gt;{try{this.style.height=this.contentWindow.document.body.scrollHeight+'px';}catch{}}, 100)\" width=\"100%\" frameborder=\"0\" scrolling=\"no\" style=\"height:400px;position:relative\" src=\"https:\/\/www.dawn.com\/news\/card\/1782467\" sandbox=\"allow-same-origin allow-scripts allow-popups allow-modals allow-forms\"><\/iframe><\/p>\n<\/figure>\n<p>Days later, the PTI <a href=\"https:\/\/www.dawn.com\/news\/1780451\">formally appealed<\/a> to the electoral body to immediately issue a detailed written order regarding the intra-party elections and poll symbol allocation. The PTI had claimed that the ECP had accepted there had been a misunderstanding and that the elections were held on June 9, 2022.<\/p>\n<p>A four-member commission, headed by Nisar Ahmed Durrani and including Shah Mohammad Jatoi, Babar Hassan Bharwana, and Justice (rtd) Ikramullah Khan, had presided over the proceedings of the case.<\/p>\n<p>Today, announcing its reserved verdict on the matter, the ECP directed the PTI to hold the intra-party elections and submit a report to the commission within seven days of it.<\/p>\n<p>The written verdict stated: \u201cWe are confirmed in our views that the respondent party failed to hold, transparent just and fair intra-party election in accordance with its prevailing constitution 2019 allegedly held on 10-06-2022, which is highly disputed\/objectionable, which could not be accepted at all.\u201d<\/p>\n<p>The order said that instead of invoking section 215(5) (eligibility of party to obtain election symbol) of the Elections Act 2017, the ECP was taking a \u201clenient view\u201d by directing it to hold the intra-party polls \u201cstrictly in accordance with the prevailing party constitution, within 20 days positively\u201d.<\/p>\n<p>\u201cIts result along with all the required documents, including Form 65, shall be submitted thereafter the election within seven days before the commission,\u201d it added.<\/p>\n<p>The verdict then warned that in case of failure to hold the polls, the PTI would \u201csuffer the penal consequences of Section 215(5) of the Elections Act 2017 accordingly and would be ineligible to obtain an election symbol for election to Majlis-e-Shoora (Parliament), etc\u201d.<\/p>\n<p>The ECP highlighted that the documents provided by the chief election commissioner had \u201cmade the alleged intra-party election highly objectionable [and] dubious\u201d.<\/p>\n<p>It added there was a \u201cglaring, un-explained contradiction, in regard to holding of intra-party election, as to whether the same was held\u201d on June 8, 2022 or June 9 or June 10 that year.<\/p>\n<p>Noting that after the polls were held, the party was supposed to submit a \u201ccertificate signed by the office bearers authorised by the party head\u201d, the ECP said \u201cno such authentic attested copy of document related to<br \/>\namendment in the 2019 constitution and of PTI intra-party election allegedly<br \/>\nheld on June 6, 2022 was provided till Aug 18, 2022\u201d.<\/p>\n<p>The verdict stated that Form-65 was submitted before the ECP on Aug 18, 2022, which was \u201cmuch after the prescribed period\u201d and cast \u201cserious doubts\u201d over holding of the intra-party elections on June 8, 2022.<\/p>\n<h2><a id=\"pti-counsel-upset-at-verdict\" href=\"#pti-counsel-upset-at-verdict\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>PTI counsel \u2018upset\u2019 at verdict<\/h2>\n<p>Barrister Khan said he was \u201cextremely upset\u201d by today\u2019s verdict, adding that the requirements of justice were not met.<\/p>\n<p>Speaking to the media outside the ECP office in Islamabad today, he claimed the verdict had been delayed for a \u201cspecial purpose\u201d.<\/p>\n<p>The lawyer said the ECP\u2019s notice had not stated that the intra-party elections were not according to the PTI\u2019s constitution. Instead, Khan asserted, the notice was about the polls\u2019 documentation being incomplete.<\/p>\n<p>Khan added that the polls were held correctly and in an open manner, along with complete documentation. He said he would challenge the order before the relevant forums.<\/p>\n<p>The lawyer expressed \u201csatisfaction\u201d that according to today\u2019s verdict, the bat was \u201cour (PTI\u2019s) symbol, it still is and it will remain on the ballot paper\u201d.<\/p>\n<h2><a id=\"pti-plea\" href=\"#pti-plea\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>PTI plea<\/h2>\n<p>Submitted through Barrister Ali Zafar, the PTI had <a href=\"https:\/\/www.dawn.com\/news\/1781995\">said<\/a> the ECP had accepted that on March 28 some misunderstanding had led to the passing of the order as to whether the party\u2019s August 2022 constitution had been withdrawn or the intra-party election.<\/p>\n<p>It said that after a hearing and submission of affidavits, the ECP had accepted that only the constitution of August 2022 had been withdrawn.<\/p>\n<p>It further said the intra-party elections of PTI were duly held on June 9, 2022, in pursuance of the party\u2019s 2019 constitution, amended up to June 8, 2022.<\/p>\n<p>This was why when the matter came up for a final hearing on Aug 30 this year, \u201cthe ECP accepted PTI\u2019s submissions and orally anno\u00adunced its decision that the elections were duly held on June 9, 2022, and, therefore, the matter stood resolved\u201d, the application had said.<\/p>\n<p>\u201cThis was also widely reported in the media.
