{"id":24355,"date":"2023-11-14T03:44:05","date_gmt":"2023-11-14T03:44:05","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/senators-demand-review-of-military-trial-verdict\/"},"modified":"2023-11-14T03:44:05","modified_gmt":"2023-11-14T03:44:05","slug":"senators-demand-review-of-military-trial-verdict","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/senators-demand-review-of-military-trial-verdict\/","title":{"rendered":"Senators demand review of military trial verdict"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>ISLAMABAD: A resolution, passed in the presence of less than a dozen senators, on Monday urged the Supreme Court to \u201creconsider\u201d its <a href=\"https:\/\/www.dawn.com\/news\/1783244\">verdict<\/a> of declaring \u201cunconstitutional\u201d the military trial of civilians for their alleged role in <a href=\"https:\/\/www.dawn.com\/news\/1751782\">attacks on army installations<\/a> on May 9.<\/p>\n<p>The resolution, which was not part of the agenda issued before the session, was tabled when a majority of members were absent. It was read out by independent Senator Dilawar Khan from Khyber Pakhtunkhwa and supported only by the Balochistan Awami Party (BAP) senators.<\/p>\n<p>The two-page resolution termed the verdict \u201can attempt to rewrite the law\u201d and an encroachment of the parliament\u2019s legislative authority.<\/p>\n<p>Before the motion was presented in the closing minutes of a private members\u2019 day, the house, for nearly two hours, debated the ongoing expulsion of \u201cillegal Afghan refugees\u201d.<\/p>\n<blockquote class=\"blockquote-level-1\">\n<p>\u2018Hasty\u2019 resolution says SC order \u2018attempt to rewrite law\u2019; minister claims over 294,000 Afghans returned voluntarily<\/p>\n<\/blockquote>\n<p>Senate Chairman Sadiq Sanjrani bypassed the rules and allowed Mr Khan to move the resolution.<\/p>\n<p>PPP Senator Raza Rabbani and JI\u2019s Mushtaq Ahmed not only voted against the resolution but also protested against the chairman\u2019s permission to table the resolution in alleged violation of rules.<\/p>\n<p>The chairman rushed the final business of the day and adjourned the house till 10am today (Tuesday), leaving the two senators protesting in front of the empty hall.<\/p>\n<p><strong>The resolution<\/strong><\/p>\n<p>The motion, read out by Senator Khan, urged the apex court to reconsider its decision in line with the \u201cnational security paradigm and sacrifices of the martyrs\u201d.<\/p>\n<p>\u201cPrima facie, an attempt has been made to rewrite the law by impinging upon the legislative authority of the Parliament,\u201d reads the resolution, a copy of which is available with <em>Dawn<\/em>.<\/p>\n<p>Other than Mr Khan, the motion carried the signatures of senators Kahuda Babar, Ahmed Khan, Prince Ahmed Omer Ahmedzai, Naseebullah Bazai and Manzoor Kakar.<\/p>\n<p>The resolution said the military trial of those accused of violence against the army was \u201can appropriate and proportional response in line with Pakistan\u2019s existing constitutional framework\u201d.<\/p>\n<p>\u201cWithin the country\u2019s constitutional framework, the trial of individuals accused of anti-state vandalism and violence under the Army Act serves as a deterrent against such acts.\u201d<\/p>\n<p>They also endorsed the concerns expressed by the martyrs\u2019 family members that the absence of military courts would \u201cencourage or embolden those responsible for acts of terrorism\u201d since regular courts can\u2019t hand out strict punishments.<\/p>\n<p>This was a reference to a press conference held by Shuhada Forum last week where they called for the \u201crestoration of military courts\u201d. The forum included the family members of the victims who lost their lives in terrorist attacks.<\/p>\n<p>Debate on Afghans\u2019 expulsion<\/p>\n<p>Earlier, the senators expressed concerns over the reports about alleged \u201cmanhandling\u201d of Afghan nationals during their deportation.<\/p>\n<p>They urged the government to provide more time to the Afghan nationals to wind up their businesses, sell properties and find suitable accommodation in Afghanistan.<\/p>\n<p>PML-N Senator Ishaq Dar also asked the caretaker government to present a clear policy to combat terrorism.<\/p>\n<p>\u201cWho told you to go to Kabul and engage the Taliban government after it came to power? Who told you to release hardened criminals who were imprisoned in Pakistan\u2019s jails \u2026?\u201d asked Mr Dar, without naming anyone.<\/p>\n<p>National Party\u2019s Tahir Bizenjo called for a meeting of the entire house to devise a new Afghan policy after consultations with all stakeholders.<\/p>\n<p>Caretaker Interior Minister Sarfraz Bugti said the crackdown was against \u201cillegal\u201d immigrants, irrespective of their nationality, according to <em>APP<\/em>.<\/p>\n<p>He said over 300,000 Afghans have so far returned to their country.
