ISLAMABAD: The Sup\u00ad\u00adreme Court has retu\u00adrned a petition against enf\u00adorced disappearances for being an \u201cindividual grievance\u201d and \u201cnot raising any question of public importance\u201d.<\/p>\n
Senior lawyer Aitzaz Ahsan had filed the application<\/a> through Advocate Sardar Latif Khosa on October 25 against the \u201cillegal and unlawful practice of enforced disappearances\u201d, including that of political leaders.<\/p>\n He sought a direction for provincial governments to submit a list of \u201cmissing persons\u201d in the custody of state authorities and a report identifying law enforcement agencies involved in this practice.<\/p>\n The Supreme Court\u2019s registrar office stated that the petition was filed under Article 184(3)<\/a>. The article gives the court an \u201cextraordinary jurisdiction\u201d and empowers it to take notice of any matter in which people\u2019s fundamental rights are violated.<\/p>\n In the note attached with the returned petition, the registrar office stated that the petition could not be entertained as Mr Ahsan didn\u2019t point out \u201cas to what questions of public importance\u201d regarding the enforcement of fundamental rights were involved in this case.<\/p>\n Furthermore, the petitioner invoked the extraordinary jurisdiction of the Supreme Court for redressing \u201can individual grievance\u201d, which was not permissible.<\/p>\n The petitioner didn\u2019t approach any other forum before filing the case \u201cand has not provided any justification for not doing so\u201d.<\/p>\n The petition<\/strong><\/p>\n In his petition, the senior lawyer had claimed that the victims of enforced disappearances included journalists, politicians, bureaucrats and other voices critical of the government.<\/p>\n It referred to the disappearance of Awami Muslim League chief Sheikh Rashid<\/a> and current and former PTI leaders, including Farrukh Habib<\/a>, Sadaqat Ali Abbasi<\/a>, Usman Dar<\/a> and anchorperson Imran Riaz Khan<\/a>.<\/p>\n Mr Ahsan requested the court to declare enforced disappearances \u201ca constitutional violation\u201d.<\/p>\n Enforced disappearances violate various provisions of the Constitution, including articles 4, 9, 10, 14, 19 and 25, it added.<\/p>\n \u201cSurely, as the guardian of fundamental rights guaranteed under the Constitution, the apex court will not look the other way while the state acts with total impunity,\u201d the petition said.<\/p>\n Published in Dawn, November 12th, 2023<\/em><\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":" ISLAMABAD: The Sup\u00ad\u00adreme Court has retu\u00adrned a petition against enf\u00adorced disappearances for being an \u201cindividual grievance\u201d and \u201cnot raising any question of public importance\u201d.
