The Sindh High Court denied issuing notice to federal and Sindh governments over repatriation of illegally staying foreign nationals in country. A division bench of the high court comprised of Justice Naimatullah Phulpoto and Justice Amjad Ali Sehto while hearing plea said that deportation of illegal immigrants is a state policy, and the court could not intervene in it.<\/p>\n

The bench sought arguments on maintainability of the petition, \u201cHow petitioner has been affected by this decision of the government,\u201d Justice Phulpoto questioned.\u201cHow could the court interfere in the state\u2019s policy and decision,\u201d Justice Sehto asked. \u201cWe could not intervene in the state policy,\u201d Justice Phulpoto remarked.<\/p>\n

\u201cPeople staying illegally in Pakistan are being deported,\u201d the bench remarked. \u201cIf any Pakistani could stay in Saudi Arabia or any other country after expiry of visa,\u201d bench questioned. \u201cYou could not stay in a foreign country for single day after expiry of visa,\u201d court maintained. \u201cHow could a person stay illegally in Pakistan,\u201d bench questioned.<\/p>\n

Petitioner\u2019s counsel said that the Pakistan\u2019s law protects rights of everyone. \u201cThe articles you are quoting as reference, only related to Pakistani nationals. Pakistan\u2019s law only protects its nationals,\u201d Justice Phulpoto remarked.<\/p>\n

The court asked petitioner\u2019s lawyer to convince the court over maintainability of the petition.<\/p>\n
