{"id":1793,"date":"2023-09-08T10:13:05","date_gmt":"2023-09-08T10:13:05","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/islamabad-atc-sends-elahi-to-jail-on-14-day-judicial-remand-in-judicial-complex-attack-case\/"},"modified":"2023-09-08T10:13:05","modified_gmt":"2023-09-08T10:13:05","slug":"islamabad-atc-sends-elahi-to-jail-on-14-day-judicial-remand-in-judicial-complex-attack-case","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/islamabad-atc-sends-elahi-to-jail-on-14-day-judicial-remand-in-judicial-complex-attack-case\/","title":{"rendered":"Islamabad ATC sends Elahi to jail on 14-day judicial remand in judicial complex attack case"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>An Islamabad anti-terrorism court (ATC) on Friday sent PTI President Parvez Elahi to jail on 14-day judicial remand in a case pertaining to the March 18 riots outside the Federal Judicial Complex (FJC).<\/p>\n<p>The March 18 events were <a href=\"https:\/\/www.dawn.com\/news\/1742856\">marred by clashes<\/a> between the police and PTI workers amid party chairman Imran Khan\u2019s appearance at the FJC in a hearing for the Toshakhana case.<\/p>\n<p>On September 5, Elahi was <a href=\"https:\/\/www.dawn.com\/news\/1774367\/islamabad-atc-grants-police-2-day-physical-remand-of-parvez-elahi-in-newly-emerged-terror-case\">arrested<\/a> in the case hours after the Islamabad High Court (IHC) had suspended his <a href=\"https:\/\/www.dawn.com\/news\/1773585\">detention<\/a> under Section 3 of the Maintenance of Public Order (MPO) ordinance and directed his release.<\/p>\n<p>On Wednesday, Elahi was presented before an ATC at the FJC, where police sought his 14-day physical remand and his lawyers urged the court to discharge him from the case. However, the ATC had granted the police two-day physical remand of the PTI president.<\/p>\n<p>During today\u2019s hearing, Elahi was presented in court before ATC Judge Abual Hasnat Zulqarnain. Lawyers Sardar Abdur Razzaq, Babar Awan and Ali Bukhari appeared as the PTI leaders\u2019 counsel while Prosecutor Tahir Kazim was also present.<\/p>\n<p>The prosecutor urged the court to extend Elahi\u2019s physical remand by another 10 days while his lawyers reiterated their plea to discharge the PTI leader from the case.<\/p>\n<p>Rejecting both pleas, the ATC then sent the former Punjab chief minister to Adiala Jail on 14-day judicial remand and ordered for him to be produced before the court on September 22. It also directed the investigation officer to furnish a report on the matter.<\/p>\n<p>Elahi\u2019s lawyers then filed a bail plea in the court, following which the ATC issued notices to the respondents, seeking their replies by September 11.<\/p>\n<p>The lawyers also summited a hand-written request to the court, urging it to allow the PTI leader\u2019s family to meet him and for home-cooked food to be provided to him due to medical reasons. Subsequently, Judge Hasnat approved the request.<\/p>\n<h2><a id=\"the-hearing\" href=\"#the-hearing\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>The hearing<\/h2>\n<p>At the outset of the hearing, the prosecutor urged the court to extend Elahi\u2019s physical remand for another 10 days, at which Judge Hasnat inquired about the previous remand granted.<\/p>\n<p>When the prosecutor informed the court that two-day physical remand was granted, Razzaq contended, \u201cThe FIR that pertains to the events of that day (March 18) does not mention Parvez Elahi\u2019s name.\u201d<\/p>\n<p>Noting that the FIR had been registered against \u201cPTI members\u201d, he claimed his client was not a part of the PTI when the FJC clashes took place and that he \u201c<a href=\"https:\/\/www.dawn.com\/news\/1738366\">joined<\/a> the PTI in April\u201d.<\/p>\n<p>Razzaq reiterated his claim that Elahi joined the PTI in April, highlighting that the case was registered in March.<\/p>\n<p>The lawyer recalled that a \u201chigh court had said that a political case was made against Parvez Elahi\u201d and ordered his release but the Gujranwala police arrested him, following which a judicial magistrate had ordered his release.<\/p>\n<p>Razzaq went on to recall the LHC\u2019s order as well wherein it had barred the police from arresting Elahi in any unknown case. \u201cIn all MPO orders, there is not even a difference of a comma, just of the name (of who issued it),\u201d he asserted.<\/p>\n<p>Retelling the events of the day Elahi was re-arrested by the Islamabad police earlier this month, the lawyer alleged that the police had not received any detention orders at that time and the DC issued the order later.<\/p>\n<p>\u201cParvez Elahi was abducted and detained in the Police Lines. He was arrested from my car within Police Lines premises,\u201d Razzaq said, submitting the LHC and IHC orders to the ATC.<\/p>\n<p>He argued that the physical remand was being sought by the police \u201con the basis of the word \u2018perhaps\u2019\u201d.<\/p>\n<p>Claiming that Imran, PTI Vice Chairman Shah Mahmood Qureshi and others had been granted bail in the same case, he urged the court to discharge Elahi from the case.<\/p>\n<p>After he concluded his arguments, Awan, another counsel, cited various past verdicts as he defended his client.<\/p>\n<p>\u201cThis case is from March. What evidence has the prosecution presented for Parvez Elahi being a terrorist?\u201d he asked. \u201cThe prosecution does not have a grain\u2019s worth of evidence against Parvez Elahi.\u201d<\/p>\n<p>In his arguments, Bukhari said that Elahi had been in police\u2019s custody for the last 72 hours, asking whether any investigation was conducted by the prosecution during this time.<\/p>\n<p>At this point during the hearing, Prosecutor Kazim began his arguments in favour of being granted physical remand.<\/p>\n<p>He insisted that the cases in Punjab were different from the current case and that the current case \u201cwould have to be looked at in its own way\u201d.<\/p>\n<p>Recalling the IHC order, Kazim claimed that the order directed for Elahi\u2019s release \u201cif not wanted in any other case\u201d.<\/p>\n<p>\u201cParvez Elahi assisted by providing cars, men and financial help, which needs to be investigated,\u201d he alleged.<\/p>\n<p>At this, the court inquired about the investigation conducted during the past two days. Subsequently, the ATC rejected the plea for further physical remand and sent the PTI president to the Adiala Jail on judicial remand.<\/p>\n<p>Following the verdict, Elahi\u2019s lawyers filed a bail plea in the court, on which notices were issued to the respondents for September 11.<\/p>\n<p>The plea also urged the court to allow Elahi\u2019s family to meet him in jail. \u201cLet Parvez Elahi\u2019s family meet him. Parvez Elahi <em>sahib<\/em>, please come forward,\u201d Judge Hasnat said.<\/p>\n<p>The former Punjab chief minister complied and said, \u201cThere is no such jail left in Punjab where I have not been sent. I also have stents in my heart.<\/p>\n<p>\u201cThe Punjab chief minister is my relative but is strongly against me,\u201d he added.<\/p>\n<h2><a id=\"the-fir\" href=\"#the-fir\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>The FIR<\/h2>\n<p>The first information report (FIR) against Elahi was registered at the CTD police station on March 18 on the complaint of Ramna police Station House Officer Malik Rasheed.<\/p>\n<p>The case pertained to the <a href=\"https:\/\/www.dawn.com\/news\/1742856\">clashes on that day<\/a> between Islamabad Police and PTI workers outside the Judicial Complex.<\/p>\n<p>The case was lodged under Sections 148 (rioting armed with deadly weapon), 149 (unlawful assembly), 186 (obstructing public servant in discharge of public functions), 353 (assault or criminal force to deter public servant from discharge of his duty), 380 (theft in dwelling house, etc), 395 (punishment for dacoity), 427 (mischief causing damage amounting to Rs50), 435 (mischief by fire or explosive substance with intent to cause damage), 440 (mischief committed after preparation made for causing death or hurt) and 506 (punishment for criminal intimidation) of the Pakistan Penal Code and Section 7 (punishment for acts of terrorism) of the Anti-Terrorism Act.<\/p>\n<p>March 18\u2019s events were marred by clashes between the police and PTI workers amid party chairman Imran Khan\u2019s appearance at the Judicial Complex in a hearing for the Toshakhana case.<\/p>\n<p>The Islamabad police had alleged that party workers had shelled the Judicial Complex and set fire to a police post. In turn, the PTI had also accused the police of shelling Imran\u2019s vehicle.<\/p>\n<h2><a id=\"timeline-of-arrests-and-rearrests\" href=\"#timeline-of-arrests-and-rearrests\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>Timeline of arrests and rearrests<\/h2>\n<p>Elahi was <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/V\">first taken into custody<\/a> on June 1 from outside his Lahore residence by the Anti-Corruption Establishment (ACE) for allegedly taking kickbacks in development projects.<\/p>\n<p>The next day, he was discharged by a Lahore court but was <a href=\"https:\/\/www.dawn.com\/news\/1757659\">rearrested<\/a> by the ACE in a similar case registered in its Gujran\u00adwala region. However, a Gujranwala court had then <a href=\"https:\/\/www.dawn.com\/news\/1757733\">discharged<\/a> him on June 3 in two corruption cases pertaining to the embezzlement of funds.<\/p>\n<p>Nevertheless, even after being discharged, the ACE then <a href=\"https:\/\/www.dawn.com\/news\/1757833\">rearrested<\/a> Elahi for \u201cillegal recruitments\u201d in the Punjab Assembly.<\/p>\n<p>On June 9, a special anti-corruption court had <a href=\"https:\/\/www.dawn.com\/news\/1758851\">given the ACE<\/a> a \u201clast opportunity\u201d to present the record of the illegal appointments case.<\/p>\n<p>The same day, the National Accountability Bureau (NAB) came into action and initiated another inquiry against Elahi for his alleged involvement in embezzlement in development projects in Gujrat and Mandi Bahauddin.<\/p>\n<p>After a sessions court on June 12 had <a href=\"https:\/\/www.dawn.com\/news\/1759436\">set aside<\/a> a judicial magistrate\u2019s decision of Elahi\u2019s acquittal in the embezzlement case, the next day, a judicial magistrate <a href=\"https:\/\/www.dawn.com\/news\/1759645\">again sent him to judicial lockup<\/a> after the LHC suspended the said order of the sessions court.<\/p>\n<p>On June 20, Elahi <a href=\"https:\/\/www.dawn.com\/news\/1760900\/parvez-elahi-gets-bail-but-others-not-off-the-hook\">finally secured relief<\/a> from an anti-corruption court in Lahore but could not be released from jail as orders for his release were not delivered to the prison administration.<\/p>\n<p>The same day, the FIA booked him, his son Moonis Elahi and three others on charges of money laundering.<\/p>\n<p>Subsequently, the next day, the FIA <a href=\"https:\/\/www.dawn.com\/news\/1760955\/lahore-court-sends-parvez-elahi-to-jail-in-money-laundering-case\">took him into custody<\/a> from jail and he was sent to jail on a 14-day judicial remand in the money laundering case.<\/p>\n<p>On June 26, a Lahore district court <a href=\"https:\/\/www.dawn.com\/news\/1761837\">again sent Elahi to jail<\/a> on a 14-day judicial remand in connection with a money laundering case, shortly after the FIA arrested him from outside the Camp Jail.<\/p>\n<p>Then on July 4, a Lahore anti-terrorism court had dismissed Elahi\u2019s post-arrest bail plea as not maintainable in a case of attacking a police team that raided his house to arrest him in an inquiry by the ACE.<\/p>\n<p>About a week later, the LHC <a href=\"https:\/\/www.dawn.com\/news\/1764175\">instructed<\/a> Inspector General of Prisons Mian Farooq to address the PTI president\u2019s complaints regarding the lack of basic facilities provided to him in jail.<\/p>\n<p>On July 12, an FIA plea against the denial of Elahi\u2019s physical remand in a case of unexplained banking transactions was <a href=\"https:\/\/www.dawn.com\/news\/1763039\">dismissed<\/a> by a Lahore sessions court.<\/p>\n<p>Two days later, the LHC had <a href=\"https:\/\/www.dawn.com\/news\/1764844\">restrained<\/a> the police and the ACE from arresting the former Punjab chief minister in any undisclosed case. However, he was then <a href=\"https:\/\/www.dawn.com\/news\/1765237\">detained<\/a> at Lahore\u2019s Camp Jail under Section 3 of the MPO.<\/p>\n<p>Upon the completion of the MPO detention, the Lahore NAB team <a href=\"https:\/\/www.dawn.com\/news\/1770085\">took Elahi into custody<\/a> from the Adiala Jail in a graft case on August 14, <a href=\"https:\/\/www.dawn.com\/news\/1770261\">remanding<\/a> him in NAB\u2019s custody for a week.<\/p>\n<p>While the LHC <a href=\"https:\/\/www.dawn.com\/news\/1771450\">upheld his protective bail<\/a> on August 21, about a week later, an accountability court <a href=\"https:\/\/www.dawn.com\/news\/1772947\/parvezs-physical-remand-extended-till-sept-2\">extended<\/a> the PTI president\u2019s physical remand till September 2 in the graft case.<\/p>\n<p>On September 1, hours after the LHC ordered his release in the graft case,  he was <a href=\"https:\/\/www.dawn.com\/news\/1773448\">rearrested<\/a> by the Islamabad police.<\/p>\n<p>Having <a href=\"https:\/\/www.dawn.com\/news\/1773698\/elahi-also-lands-in-attock-jail-petitions-ihc-against-detention\">approached<\/a> the IHC, the court suspended Elahi\u2019s MPO detention and ordered his release but hours later, he was <a rel=\"noopener noreferrer\" target=\"_blank\" class=\"link--external\" href=\"https:\/\/v\">again re-arrested<\/a> in a terror case pertaining to the March 18 FJC violence.<\/p>\n<hr\/>\n<p><em>More to follow<\/em><\/p>\n<\/p><\/div>\n","protected":false},"excerpt":{"rendered":"<p>An Islamabad anti-terrorism court (ATC) on Friday sent PTI President Parvez Elahi to jail on 14-day judicial remand in a case pertaining to the March 18 riots outside the Federal Judicial Complex (FJC).
