{"id":17517,"date":"2023-10-24T15:23:06","date_gmt":"2023-10-24T15:23:06","guid":{"rendered":"https:\/\/news.pakistaninewspaperlist.com\/ihc-extends-nawazs-protective-bail-in-avenfield-al-azizia-references-till-oct-26\/"},"modified":"2023-10-24T15:23:06","modified_gmt":"2023-10-24T15:23:06","slug":"ihc-extends-nawazs-protective-bail-in-avenfield-al-azizia-references-till-oct-26","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/ihc-extends-nawazs-protective-bail-in-avenfield-al-azizia-references-till-oct-26\/","title":{"rendered":"IHC extends Nawaz\u2019s protective bail in Avenfield, Al-Azizia references till Oct 26"},"content":{"rendered":"<p><\/p>\n<div dir=\"auto\">\n<p>The Islamabad High Court on Tuesday extended PML-N supremo Nawaz Sharif\u2019s protective bail in the <a href=\"https:\/\/www.dawn.com\/news\/1418326\">Avenfield<\/a> and <a href=\"https:\/\/www.dawn.com\/news\/1452815\">Al-Azizia<\/a> cases \u2014 in which he had been convicted \u2014 till October 26, after the National Accountability Bureau (NAB) said it had \u201cno objections\u201d to the plea filed by the deposed prime minister.<\/p>\n<p>An IHC division bench, comprising Chief Justice Aamer Farooq and Justice Miangul Hassan Aurangzeb, issued the order on Nawaz\u2019s petitions seeking protective bail in the cases and restoration of his appeals against his conviction.<\/p>\n<p>In July 2018, ousted Nawaz was <a href=\"https:\/\/www.dawn.com\/news\/1418326\">handed 10 years in jail<\/a> in the Avenfield properties corruption reference for owning assets beyond known income and one year for not cooperating with the NAB, which was to be served concurrently.<\/p>\n<p>The Al-Azizia Steel Mills corruption reference pertains to the case in which he was <a href=\"https:\/\/www.dawn.com\/news\/1452815\">sentenced to seven years<\/a> in jail on Dec 24, 2018 and then taken to Rawalpindi\u2019s Adiala Jail, from where he was <a href=\"https:\/\/www.dawn.com\/news\/1453509\">shifted<\/a> to Lahore\u2019s Kot Lakhpat jail next day. He was also fined Rs1.5 billion and US$25 million in the case.<\/p>\n<p>Nawaz was <a href=\"https:\/\/www.dawn.com\/news\/1471981\">released<\/a> from jail in March 2019, following which he <a href=\"https:\/\/www.dawn.com\/news\/1517603\">left for London<\/a> in November 2019 after the LHC allowed him to do so. The IHC declared him a proclaimed offender in both cases in December 2020.<\/p>\n<p>Last week, the IHC had <a href=\"https:\/\/www.dawn.com\/news\/1782055\">confirmed<\/a> Nawaz\u2019s protective bail in the cases till Oct 24, paving the way for his <a href=\"https:\/\/www.dawn.com\/news\/1782567\/no-wish-for-revenge-nawaz-says-in-homecoming-lahore-power-show+\">homecoming<\/a> on Oct 21.<\/p>\n<p>During the proceedings today, Nawaz appeared before the court along with his brother Shehbaz Sharif and several other party leaders.<\/p>\n<p>At the outset of the hearing, PML-N\u2019s Azam Nazir Tarar said the accountability court had suspended Nawaz\u2019s warrants in the Toshakhana case and approved his bail against surety bonds.<\/p>\n<p>Here, Justice Farooq said there were two petitions in front of the high court, both of which were related to restoring appeals against Nawaz\u2019s conviction. \u201cWe have to issue notices on these applications,\u201d the judge added.<\/p>\n<p>Meanwhile, Justice Aurangzeb said that for the restoration of the appeals, the petitioner had to explain why he remained absent from the court.<\/p>\n<p>At that, Tarar said: \u201cWe just want to move as per the law and you are an expert at that.\u201d<\/p>\n<p>However, Justice Farooq maintained that keeping Article 10-A (right to a fair trial) of the Constitution aside, the petitioner had to provide an explanation for his absences from the court.<\/p>\n<p>\u201cYou will have to prove that your absences were not deliberate and based on ill intention,\u201d Justice Farooq added.<\/p>\n<p>For his part, Tarar said the Lahore High Court had granted Nawaz permission to leave the country over medical reasons.<\/p>\n<p>\u201cYou have made a mistake here,\u201d Justice Farooq pointed out, asking that if matters were pending in one high court, could another high court allow that.<\/p>\n<p>Justice Aurangzeb also questioned the law a court had to follow when petitions had been filed for restoration of appeals.<\/p>\n<p>\u201cThis is not a matter of routine, this is a matter of show cause,\u201d the IHC CJ remarked, adding that the court would issue notices to the opposing side. \u201cIt is necessary for the court to be satisfied by your reasons,\u201d he said.<\/p>\n<p>At one point, PML-N\u2019s Tarar requested the court to extend Nawaz\u2019s protective bail so that they could prepare for further arguments to which Justice Farooq asked the prosecutor general of NAB to give his opinion on the matter.<\/p>\n<p>In his response, the NAB official said the bureau had read the petition for restoration of appeal and did not have any objections to it.  He further said that they had no objections to the extension in the protective bail.<\/p>\n<p>\u201cIs this the same NAB?\u201d Justice Aurangzeb asked here. \u201cI am hearing these cases after five years and am trying to understand if this is the same NAB,\u201d he said.<\/p>\n<p>\u201cIs the NAB saying that charges of corrupt practices should remain, but the convict should be released?\u201d the judge further asked. \u201cLet\u2019s ask the NAB chairman why he is wasting public time.\u201d<\/p>\n<p>Justice Aurangzeb also asked: \u201cIf NAB has no objections, why doesn\u2019t it take back the case?\u201d He then asked the bureau\u2019s prosecutor general to take a \u201cdefinitive position\u201d and instructed him to communicate NAB\u2019s clear position on the matter at the next hearing.<\/p>\n<p>The court subsequently issued notices to the NAB on Nawaz\u2019s pleas for restoration of the appeals against his conviction and bail. It also extended the PML-N supremo\u2019s protective bail till Thursday.<\/p>\n<p>Earlier, talking to reporters, Nawaz was asked if he would participate in the upcoming polls to which the PML-N supremo smiled.<\/p>\n<h2><a id=\"bail-confirmed-in-toshakhana-case\" href=\"#bail-confirmed-in-toshakhana-case\" class=\"heading-permalink\" aria-hidden=\"true\" title=\"Permalink\"\/>Bail confirmed in Toshakhana case<\/h2>\n<p>Separately, an Islamabad accountability court confirmed the PML-N supremo\u2019s bail in the Toshakhana case.<\/p>\n<p>The accountability court had <a href=\"https:\/\/www.dawn.com\/news\/1782055\">suspended<\/a> the perpetual arrest warrants <a href=\"https:\/\/www.dawn.com\/news\/1562984\">issued in 2020<\/a> for Nawaz in the Toshakhana case on October 19.<\/p>\n<p>The case alleges that Nawaz, former president Asif Ali Zardari and ex-prime minister Yousuf Raza Gilani received luxury vehicles and gifts from the Toshakhana \u2014 a department that stores gifts given to rulers, parliamentarians, bureaucrats and officials by heads of other governments, states, and foreign dignitaries.<\/p>\n<p>In June 2020, an accountability court had issued non-bailable arrest warrants for the former premier. Months later, Nawaz <a href=\"https:\/\/www.dawn.com\/news\/1574629\">challenged<\/a> the warrants in the Islamabad High Court but had <a href=\"https:\/\/www.dawn.com\/news\/1575596\">withdrawn<\/a> the petition days later.<\/p>\n<p>On Sept 10, 2020, he was <a href=\"https:\/\/www.dawn.com\/news\/1578894\">declared<\/a> a proclaimed offender in the case, with an accountability court initiating the process to confiscate his properties and directing the National Accountability Bureau (NAB) to make his arrest through Interpol.<\/p>\n<p>Islamabad police provided the PML-N supremo with special security as he made his way to court, joining his protocol at the Toll Plaza.<\/p>\n<p>Footage aired on television of Nawaz\u2019s arrival at the accountability court showed his car, which had been showered with rose petals, going through the gate with a large number of PML-N supporters gathered at the back.<\/p>\n<p>PML-N leaders Shehbaz Sharif, Ahsan Iqbal, Khawaja Asif, Ayaz Sadiq and Saad Rafique were also present for the hearing, which was presided over by Judge Muhammad Bashir.<\/p>\n<p>At the outset of the hearing, the court directed to mark Nawaz\u2019s attendance. The hearing, however, was marred by commotion after which the court directed Nawaz to leave the courtroom.<\/p>\n<p>When the hearing resumed, the NAB prosecutor contended that Nawaz had surrendered, therefore, his arrest warrants should be cancelled. \u201cIf the warrants are cancelled then the trial can move forward,\u201d he said.<\/p>\n<p>The court subsequently confirmed Nawaz\u2019s bail in the case against surety bonds of Rs1 million.
