{"id":113342,"date":"2026-09-14T10:34:37","date_gmt":"2026-09-14T10:34:37","guid":{"rendered":"https:\/\/pakistaninewspaperlist.com\/news\/court-admits-petition-challenging-sohail-afridis-election-as-kp-cm\/"},"modified":"2026-09-14T10:34:37","modified_gmt":"2026-09-14T10:34:37","slug":"court-admits-petition-challenging-sohail-afridis-election-as-kp-cm","status":"publish","type":"post","link":"https:\/\/pakistaninewspaperlist.com\/news\/court-admits-petition-challenging-sohail-afridis-election-as-kp-cm\/","title":{"rendered":"Court admits petition challenging Sohail Afridi\u2019s election as KP CM"},"content":{"rendered":"<div style=\"font-size:16px;line-height:1.6\">\n<p><strong>ISLAMABAD: The Federal Constitutional Court (FCC) has admitted for hearing a petition seeking to declare the election of Khyber Pakhtunkhwa Chief Minister Sohail Afridi null and void.<\/strong><\/p>\n<p>The court issued notices to the KP government and Chief Minister Sohail Afridi, while the Attorney General for Pakistan was also issued a notice to assist the court in the case.<\/p>\n<p>During the hearing, Justice Aamir Farooq asked the petitioner\u2019s counsel, Sher Afzal Marwat, what constitutional question arose in the case.<\/p>\n<p><div class=\"ast-oembed-container \" style=\"height: 100%;\"><iframe title=\"Federal Constitutional Court Admits Case Challenging Sohail Afridi\u2019s Election\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/TXq9VHb5KGk?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/div>\n<p><span data-mce-type=\"bookmark\" class=\"mce_SELRES_start\">\ufeff<\/span><\/iframe><\/p>\n<p>Marwat argued that former KP Chief Minister Ali Amin Gandapur had not resigned voluntarily, but had submitted his resignation on the instructions of PTI founder Imran Khan.<\/p>\n<p>He maintained that the Constitution envisages that a public office-holder can resign only voluntarily. According to Marwat, Gandapur had mentioned in his resignation letter that he was stepping down on the instructions of the PTI founder.<\/p>\n<p>Marwat further argued that the governor had not accepted Gandapur\u2019s resignation and that the governor\u2019s acceptance was necessary for the chief minister to be formally de-notified.<\/p>\n<p>During the proceedings, Justice Ali Baqar Najafi observed that another resignation had been submitted two days later. Marwat responded that the second resignation may also not have been accepted.<\/p>\n<p>Referring to the Supreme Court\u2019s judgment in the Nawaz Sharif party presidency case, Marwat argued that the apex court had held that a disqualified person could not run the state through a proxy.<\/p>\n<p>He contended that Imran Khan was disqualified when he instructed Gandapur to resign, adding that running the state through a proxy amounted to undermining the Constitution.<\/p>\n<p>The Federal Constitutional Court subsequently admitted the petition for regular hearing and issued notices to the KP government, Sohail Afridi and the Attorney General for Pakistan.<\/p>\n<p>Further proceedings in the case have been adjourned until the second week of October.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>ISLAMABAD: The Federal Constitutional Court (FCC) has admitted for hearing a petition seeking to declare the election of Khyber Pakhtunkhwa Chief Minister Sohail Afridi null and void.
