PTI petition against RO appointment amounts to ‘violation’ of SC order, CJP Isa remarks

Chief Justice of Pakistan (CJP) Qazi Faez Isa on Friday remarked that the PTI’s petition contesting the appointments of bureaucrats as returning officers (ROs) and district returning officers (DROs) for the February 8 general elections amounts to the “violation” of a previous apex court order.

The Supreme Court (SC) is currently hearing a petition by the Election Commission of Pakistan (ECP) challenging the Lahore High Court’s (LHC) order suspending the appointment of ROs and DROs from the bureaucracy.

A three-member bench comprising CJP Isa and Justices Mansoor Ali Shah and Sardar Tariq Masood is presiding over the hearing.

The development comes a day after the ECP paused a training session for ROs and DROs — an exercise without which polls on February 8 could be in trouble.

The ECP’s move had come in response to an LHC order suspending the electoral watchdog’s notification regarding the appointment of ROs and DROs from the bureaucracy.

The high court order, which was issued on a petition submitted by the PTI, seemingly brought the electoral process to a standstill, causing widespread concern among political parties — including the petitioner PTI — regarding general elections.

While announcing the verdict, LHC’s Justice Ali Baqar Najafi had referred the PTI petition to the chief justice with a request to constitute a larger bench to decide the matter.

In its petition in the high court, the PTI had contested the appointments of bureaucrats to act as DROs and ROs for the upcoming general elections and sought the appointment of officials from the lower judiciary for the poll exercise.

After the order, the ECP’s announcement of the election schedule, which was expected this week, now seems to be in limbo.

Talking to reporters upon his arrival at the apex court tonight (Friday), ECP Secretary Omar Hamid Khan said a petition was prepared, answering in the affirmative when questioned if it was against the LHC’s direction.

He added that nothing could be said at the moment about the Feb 8 general elections.
